First-degree sentence of the Diamante trial (Genoa, Italy, July 5, 2023)

The first-degree sentence of the Diamante trial against anarchist comrades Evelin and Gianluca (arrested on March 16th, 2022) was read out today, July 5th, at the Genoa court. Evelin was acquitted of all accusations and Gianluca was convicted to 4 years and 6 months of prison (plus a fine of 15,000 euro) for ‘illegal possession of explosives’ (art. 1 and 2 of law 895/67) and ‘attempted crime’ (art. 56 c. p., Italian criminal code), while he was acquitted of the accusation of ‘manufacture or possession of explosive materials with the purpose of endangering public safety’ (art. 435 c. p.). The comrades were not tried under the ‘aggravating circumstance of the purpose of terrorism or subversion of the democratic order’ (in relation to art. 270 bis 1 c. p.) because for this aggravating circumstance, present during the investigation phase, there had been no indictment for trial. The prosecutor’s requests had been for 5 years and 6 months (plus a fine of 15,000 euro) for Evelin and 9 years and 6 months (plus 30,000 euro) for Gianluca. We recall that the latter is still under house arrest with all restrictions (prohibition of meetings with persons other than close family members, prohibition of communication and exit permits, etc.). On July 5th, the court of Genoa will hold the hearing for the sentence in the trial against anarchists Gianluca and Evelin, who were arrested on March 16th, 2022, within the Diamante investigation and charged with fabrication and possession of explosive and explosive material. During the hearings on June 7th and 8th, the prosecutor requested a sentence of 9 years and 6 months (plus a fine of 30,000 euros) for Gianluca and 5 years and 6 months (plus 15,000 euros) for Evelin. We recall that Gianluca — who is also under investigation in the Sibilla proceeding against the anarchist paper ‘Vetriolo’ — is still under house arrest with all the restrictions for the Diamante trial (the comrades were transferred to house arrest after a period of imprisonment in Rome’s Rebibbia prison), while Evelin was released in April 2022 following the re-examination hearing on the precautionary measures.

Update on the June 7-8 hearings of the Diamante trial: prosecutor’s indictment and upcoming hearing for the sentence (Italy)

On June 7th and 8th, at the Court of Genoa, there was the prosecutor’s indictment and the defence lawyers’ discussion of the trial against anarchist comrades Evelin and Gianluca. The prosecutor’s requests were for 5 years and 6 months and a fine of 15,000 euro for Evelin and 9 years and 6 months and 30,000 euro for Gianluca [the comrade is currently under house arrest with all restrictions].

A further hearing was postponed to July 5th for the reading of the first-degree sentence.

UPDATES on the GENOA TRIAL of GIANLUCA and EVELIN.

The undoubted crisis that the capitalist mode of production is going through today manifests itself in an economy that bases its wealth on war, on the robbery and plundering of the commodity-rich global south, and in the sharpening of the class struggle.

While it is true that capitalism continually seeks “alternative” solutions that will ensure its continuation, often succeeding in finding them and thus creating new pockets of profit for the market, it is also true that the resource crisis and especially today’s climate crisis will not grant alternatives to this parasitic presence for long.
The commodity crisis affects not only the production of secondary consumer goods in the technology, war and digital industries, but also primary resources such as water. This leads not only to a change in geopolitical arrangements, but also to internal conflicts between exploited and exploiters as the example of reservoirs in France or mining in Germany highlights. Objectively, even in Italy, beyond the obvious shortcomings of radical opposition initiatives, the “hunt for ore” or residual gas supplies are accentuating the extractive machine of ruthless multinationals that destroy territories to increase their profits, with the favor of state concessions.

But the crisis of production is a possible prospect today, which is why states are organizing in an attempt to assert their interests and prevent radical struggles and forms of internal guerrilla warfare.

Against this backdrop the authoritarian turn underway in Italy and elsewhere takes shape, which on the one hand is evident in the adoption of economic and “social” policies aimed at ever greater class exploitation, and on the other in the tightening of repression against political crimes.

In the last period the authoritarian turn taken by the state has clearly and heavily characterized the exclusively political reading of social events and struggles by entering even the judicial spheres. It has strongly conditioned the use of repression with the application of punitive instruments that remain an objective problem for political prisoners, such as 41 bis, hostility and crimes arbitrarily reinterpreted, reformulated and used in a vindictive way as massacre and associative crimes. Democracy cannot allow certain thoughts to be clearly expressed, and certain words to be used with impunity, because they could make inroads among the oppressed, among the excluded. These words without stakes take on greater weight for me because they cost me and will cost me more years in prison, but it’s my way of resisting, of fighting back.

On the night of 31 March we attacked some vehicles of the IREN group with fire, a leading company in Italy in the district heating service, operating in the production and distribution of electricity and technological services. IREN is a young company but with a veteran entrepreneurial posture in line with all the other criminal multinationals such as ENI and Benetton that profit from the destruction and looting of territories around the planet. This was enough to put the IREN group in our sights, if we then add, in recent weeks’ news, that IREN has entered into agreements with the Israeli Mekorot water company which implements water apartheid from the Palestinian people, then the choice of attacking her was more than spot on. Our thoughts go to Alfredo who, with his struggle, a true manifesto of dignity and freedom, gave us the strength and courage to put ourselves on the line. May the flames of this attack warm his body after more than five months of hunger strike. We close this article with a clarification: we do not participate in the dichotomy that the regime’s politicians and media are promoting, that of a struggle between an anarchist against the state. Anarchists declared war on authority almost two centuries ago, certainly not on October 20, 2022 – the start of Alfredo’s hunger strike. You must understand that if Alfredo were to die or remain alive, if Alfredo were free or would remain a prisoner, we have already declared ourselves your bitter enemies some time ago and we will continue to be however things go.

Italy: Update on Operation Sibilla: hearing set for Alfredo Cospito and other comrades under investigation at Perugia review court

On Feb. 13, the setting of the review hearing on precautionary measures was notified for comrades targeted for measures in the November 11, 2021 Sibilla repressive operation (including Alfredo Cospito, who has been on hunger strike for more than 120 days, and Gianluca, who is currently under house arrest in the Diamante investigation by the Genoa prosecutor’s office). The hearing is set for March 14 at the court in Perugia.

This second re-examination stemmed from the hearing held on June 22 in Rome at the court of cassation, which concluded by granting prosecutor Manuela Comodi’s request, thus annulling the previous order of the review court (which on Dec. 16, 2021 had resulted in the revocation of the precautionary measures). The court of cassation, in spite of what had been expressed by the attorney general (who had called for the rejection of the Perugian prosecutor’s appeal), had thus “exhumed” the investigation by annulling the revocation of the measures and ordering a new review hearing.

Operation Sibilla, carried out by the Carabinieri’s Special Operational Group and the Perugia prosecutor’s office under the coordination of the National Anti-Mafia and Counterterrorism Directorate, played a key role in the genesis and application of the 41 bis detention order for comrade Alfredo Cospito.

Eight comrades (including Alfredo himself), previously investigated by the ROS and the Milan Prosecutor’s Office in another case for 270 bis c. p. (subversive association for the purpose of terrorism and subversion of the democratic order) and 414 c. p. (incitement to commit a crime, with the aggravating factor of the purpose of terrorism) in connection with the editing, publication and distribution of the anarchist newspaper “Vetriolo,” had been the subject in September 2021, by the Perugia prosecutor’s office, of a request for precautionary measures in prison on the same charges, plus other charges for various reasons relating to additional articles, leaflets and documents, as well as wall writings and for one comrade to a damage to some Poste Italiane cars (Foligno, June 6, 2019) in solidarity with anarchist comrades on hunger strike over the closure of the High Security 2 section of the L’Aquila prison.

At the same time as this request for arrest, a three-month censure order on correspondence was ordered for comrade Alfredo Cospito, which was subsequently renewed several times. The reasons for this censure became clear only a couple of months later, when – with the November 11 operation – the Sibilla investigation “emerged” and PM Comodi’s original request was downgraded by the Judge for Preliminary Investigations. Thus, a new order established no longer eight arrests in prison but six precautionary measures in relation only to the charge of incitement to commit crimes with the aggravating factor of the purpose of terrorism: an arrest warrant for Alfredo Cospito (at the time imprisoned in Terni Prison); house arrest with all restrictions for a comrade from Spoleto; and an obligation to stay in the municipality of residence jointly with the obligation to sign three days a week for four comrades. In addition, other comrades turned out to be under investigation at large, countless searches were carried out, and two websites (roundrobin.info and malacoda.noblogs.org) were subjected to preventive seizure and blacked out (a practically unprecedented fact as far as the Italian-speaking anarchist movement is concerned), remaining unreachable to this day with conventional search engines. Genoa, Italy: Nat, Beppe and Robert also acquitted at appeal trial for Operation Prometeo

Genoa Jan. 23 – Nat, Beppe and Robert were also acquitted on appeal for not having committed the act. The three comrades were arrested by Ros carabinieri in 2019 as part of Operation Prometeo, as they were believed to be the authors of package bombs sent in 2016 to two Turin magistrates and the director of the Dap in Rome.

The charge for Giuseppe Bruna, Robert Firozpoor and Natascia Savio was bombing.

According to the indictment, the three comrades allegedly sent the explosive packages, which were intercepted before they were delivered, to Turin prosecutors Roberto Maria Sparagna and Antonio Rinaudo, who were engaged in investigations into the anarchists, and to Santi Consolo, then director of the Dap in Rome. According to investigators, the comrades had met in Genoa and planned and assembled the parcel bombs. Framing them would be one of the envelopes on which a price tag from a Chinese goods store in the Ligurian capital had been left.

This morning outside the courthouse some 20 comrades organized a gathering in solidarity with Nat, Beppe and Robert and Alfredo Cospito. A number of banners were then hung in San Lorenzo Square.

At the opening of what will likely be the last appeal hearing in the Prometo trial, the defendants present took the floor at the opening of the hearing to read the following brief statement:

“Genoa, January 23, 2023, The question of solidarity, for us anarchists, is fundamental, diriment. That is why today we cannot refrain from taking the floor in this courtroom, knowing that there is someone who is being prevented from doing so. Alfredo Cospito is today on his ninety-sixth day of hunger strike in the prison of Bancali, Sassari, to protest, in the only way he is allowed in the tomb for the living in which he is locked up, against the repressive abominations of 41 bis and hostile life imprisonment. The institutions are all demonstrating their democratic ferocity by entrenching themselves in a muteness that reeks of retaliation and ineptitude. If this, then, is claimed to be a courtroom, no man or woman of conscience should sit idly by, aware that the hands, for Alfredo, are about to stop on the last hour, minute, second, in a prison of this torture-smelling state. A cry should rise where justice was sovereign, real, possible:
AGAINST 41 BIS
AGAINST HOSTILE LIFE IMPRISONMENT
FOR THE IMMEDIATE DOWNGRADING OF ALFREDO COSPITO, FREEDOM.”

The presiding judge ruled that thirty seconds was too long, and interrupted them after just a few lines. After a brief squabble with the comrade who was reading, in the face of the disinterest that these characters are bringing to bear at all levels of this affair, confirming that a curtain of silence is to be drawn over this story, the fellow defendants and sympathizers decided to leave the courtroom, taking to the streets the story of this morning and the reasons for Alfredo’s protest.

Italy: Brief account of the preliminary hearing in the Genoa trial against Gianluca and Evelin

At the preliminary hearing held at the Genoa Court on Dec. 7, both defendants were remanded for trial in relation to the crimes charged against them, excluding the aggravating circumstance charged under Art. 270 bis 1 c. p.

The trial will therefore begin with the filter hearing on March 7, and under the ordinary procedure remands both on charges of possession and carrying explosive material, attempted manufacture of explosive/explosive devices. Technically resuming the legal motivation, with regard to the disqualification of the purpose of terrorism, reference is made to the most recent case law on the matter, particularly Supreme Court ruling no. 36816/2020, according to which “it is not sufficient to carry out any violent political action, as it is necessary that the conduct is potentially capable of creating panic, terror and widespread sense of insecurity in the community and is aimed at organs of institutional leadership or constitutional importance, as a function of the attempt to overthrow the constitutional order or overthrow the democratic system.”
In the present case, the judiciary ruled, in line with the preliminary investigation judge’s previous assessment, that there could be no connection between the seized material and the violent actions induced by the prosecution, so the defendants are remanded for trial on the charges outlined above, subject to appeal by the prosecutor.

In addition to this small technical account of the hearing, below are some reflections on repression as a general and continuous activity of the state against the exploited.
Behind every legal choice, college or individual judge, there is a political choice that characterizes sentencing. Repressive activity is not always related in a directly proportional and linear way to the intensity of conflict that social and militant classes pose. The activity of preventing the conflict hypothesis and that of annihilating the internal enemy is continuous on the part of the state, and is aimed at maintaining order and class privilege. There are no happy islands or terms of action and thought within which the repressive response can be avoided, although the absence of radicality in the struggle, by taking away strength from the revolutionary possibility, determines in the social sphere and in the power relations only points in favor of the other side.
These days, with reference to comrade Alfredo Cospito’s struggle, it is pointed out that it is always ready for the annihilation of revolutionaries, through the instrument of torture, which practiced directly, more or less systematically in different historical periods, tends to control and repress every revolutionary expression and struggle, placing the monopoly of violence that characterizes its power at the center, and lashing out against anyone who dares to question this.
The vindictive tendency of the state is aimed at the annihilation of revolutionary identities and serves as a warning to the social partners struggling against the vicious conditions that capitalist exploitation imposes.
