Italy: “Brenner” trial appeal sentence

Posted on 2023/04/01 by darknights

“Brenner” trial appeal sentence

On March 17, the appeal verdict in the trial for the May 2016 anti-borders demonstration at the Brenner Pass was handed down at the Bolzano court.

While there was a general lowering of the sentences (from 150 to 123 years total, with 8 acquittals due to the statute of limitations of the crime), the balance is still heavy (keep in mind that the trial was in abbreviated form). 28 female comrades and comrades received sentences above 2 years, while 5 comrades took more than 4 years (the highest sentence was 5 years and 1 month in prison) for conspiracy to commit aggravated resistance, private violence, injury, etc. The charge of devastation and looting did not hold up, as it did in the first instance.

Another significant element is that the judge denied all and sundry who applied for it access to the so-called Cartabia reform. Although the sentencing date had been formally postponed to allow defendants and defendants to make use of the new law, the request to access it was denied under the pretext of the criminal records and “social dangerousness” of defendants and defendants. But there is an even more emblematic fact: the main argument for the rejection of “substitute sentences” has been the defendants’ failure to abjure their conduct. The increasingly overtly rewarding nature of sentencing applies not only to the supervisory judiciary, but also to ordinary courts. What makes the difference on the type of sentence is not so much the offense itself, but whether or not the defendant “repents.”

For more than 30 defendants and defendants, therefore, prison doors may open in the future.

This ruling only prolongs the structural violence of state racism, that set of laws, neocolonial practices, administrative detention and police devices that produce massacres, mass deaths and a humanity forced into conditions of semi-slavery. From the harvesting in the fields to the many sectors of the “informal economy,” from the blackmail of the residence permit – which weighs on logistics, construction, catering, “care work”… – to the fat black rental market, the terror exercised by the borders is as strategic as it is unmentionable part of capitalist exploitation.

123 years in prison for a motorcade blatantly tells us that we are at war, that the margins of permissible dissent are shrinking, and that non-negotiated conflict is a desertion from the frontline to be punished in an exemplary fashion.

The anti-immigrant wall at the Brenner Pass-which the Austrian police had called a mere “technical solution” …-was not built. Perhaps also thanks to those who fought with generosity and courage that May 7, 2016.

Solidarity with the convicted comrades and comrades.

Italy: The request for deferral of Alfredo Cospito’s sentence to house arrest rejected by the Supervisory Courts of Milan and Sassari

The request for deferral of Alfredo Cospito’s sentence to house arrest rejected by the Supervisory Courts of Milan and Sassari

27/3/23: The Supervisory Court of Milan replied by rejecting the request for house arrest for health reasons for anarchist prisoner Alfredo Cospito.

At the same time the Sassari court reached the same decision. In both cases with the long motivations already written. The comrade’s behaviour is defined instrumental in obtaining changes in political and judicial decisions.

While contradictions are accumulating within the political and judicial apparatuses (e.g., opinion of the National Anti-Mafia and Anti-Terrorism Directorate, the Attorney General of the Supreme Court, Sibilla re-examination, etc.) each time one is faced with an organ that has the power to resolve the question raised by the comrade’s struggle immediately, the party of the death sentence applies all its political power to block any possible way out.

This was in all probability the last chance. To all of us the human and historic task to make the State pay the highest possible price for this murder. Now and in the future.

Leipzig, Germany: Repression Can Be Expensive – Fire at Skoda

Posted on 2023/03/25 - 2023/03/25 by darknights

Last night, we went out and attacked several new cars of a Skoda dealer in East Leipzig with fire as a reaction to the house searches against antifascists last week. In doing so, we surrendered a total of 19 cars to the flames with simple means – 12 of them burned out completely, the rest were heavily damaged. Skoda proudly participates in equipping police units around the world.

On Wednesday, March 15 – of all days on the international day against police violence – the police stormed 5 apartments of antifascists in Jena and 3 in Leipzig with machine guns at the ready. In the same afternoon, a special task force attacked an entire house on the Eichendorffstraße in Connewitz and even shot(!) several doors open. As background, they named the attacks on neo-Nazis around an international fascist meeting in Budapest in February. Also in Karlsruhe, a house search took place, in which the pigs also proceeded with extreme brutality, background here were the protests against the AfD state party conference in Offenburg.

We were inspired by the call to react to every further wave of raids with plenty of damage to property as well as the practical proposals of the companions, who had already decided on an offensive reaction after the last wave of house searches in Leipzig, and we have already started – so that many more actions may follow!

We have chosen Skoda as a target, because they have been involved in equipping repressive organs all over the world for decades – be it in France, where the flics (cops) are currently trying to put down the social revolt raging there with full force, or in Italy, where the anarchist Alfredo Cospito is currently wrestling with death. With this action, we want to send him and all fighting companions flaming greetings of solidarity.

We are already looking forward to coming together with you militantly on Day-X in the Antifa Ost (Antifa East Germany) proceedings and to collectively oppose the current wave of repression. In case administration, cops or courts think about authoritarian measures against the demo like bans again, they should be clear: This time we are prepared, and it will be really expensive!

Freedom and good luck for all persecuted antifascists, whether in prison or on the run!
Alfredo Libero! For the revolt!

Italy: Alfredo Cospito’s statement at the review hearing for the Operation Sibilla pre-trial measures

Posted on 2023/03/23 by darknights

Alfredo Cospito’s statement at the review hearing for the Operation Sibilla pre-trial measures

First, I wanted to begin with a quote from my instigator:

“Our system has introduced that figure of mortuary isolation that is 41 bis, and that in some respects is more uncivilized even than this pharmacological mutilation. This is to say that our system does not shine with civilization.”
Carlo Nordio, March 28, 2019

This was my instigator of the struggle I started. I never thought I would get this far, I always found melodrama ridiculous, I love comedy more, but that’s how it was. After all, are we or are we not the country of melodrama? And so I have to end on a high note. When I think about it, though, something ironic is there: I am the only asshole who dies in the progressive democratic West because he is prevented from reading and studying what he wants, anarchist newspapers, anarchist books, historical and scientific journals, without neglecting his beloved comic books.

You will admit that this is paradoxical and even a bit funny, I can’t live this way, I just can’t do it, I hope those who love me will understand. I can’t do it to surrender to this non-life, it is stronger than me, maybe because I am an anarchic Abruzzese stubborn. I am certainly not a martyr, martyrs make me somewhat repulsed. Yes, I am a terrorist, I shot a man and proudly claimed that deed even though, let me tell you, the definition makes a bit of a laugh in the mouth of representatives of states that have wars and millions of dead on their conscience and sometimes, like one of our ministers, get rich from the arms trade. But what can we do, that’s the way of the world, at least until anarchy triumphs and true socialism, the antiauthoritarian and antistatalist kind, finally sees the light of day. Tough luck you will say, and so will I, for now the only glimmers of light I see are the acts of rebellion by my revolutionary brothers and sisters around the world, and they are certainly no small thing, because they are done with heart, passion and courage, no matter how scattered and scrappy they may seem. Claim of the incendiary attack against Poste Italiane in response to the internationalist solidarity call for the release of comrade Marcelo Villarroel (Rome, March 18, 2023)

CLAIM OF THE INCENDIARY ATTACK AGAINST POSTE ITALIANE

IN RESPONSE TO THE INTERNATIONALIST SOLIDARITY CALL FOR THE RELEASE OF COMRADE ANARCHIST MARCELO VILLARROEL.

“THE URGENCY OF THE ATTACK DEMANDS FIRMNESS.”

MARCH 18: SOMEWHERE IN ROME

We greet the 150th day of our brother and comrade Alfredo Cospito’s hunger strike by giving ourselves the joy of attacking with fire the infrastructure of the Italian state, specifically we set fire to 16 cars owned by Poste Italiane.

Proud to join the campaign of revenge, against the abomination of 41 bis, the hostile life sentence and Alfredo’s death sentence launched against the Italian state, we choose to respond with this attack to the internationalist call to action in solidarity with Marcelo Villarroel 15 years after his arrest and in the context of the permanent campaign for his release proposed by comrades:
– Individualidades Afines
– Red Solidaria Antikarcelaria con Juan y Marcelo (RSAJM)

Against an existent that oppresses us on a daily basis and so that the impetus given to us by the hunger strike of anarchist comrade Alfredo Cospito does not fade, we declare a permanent emergency (which gives us the urgency of our short lives) regardless of the outcome of the struggle our comrade has undertaken.

To the wait-and-see hope of a social revolution we place before the joy of denying the present without being clouded by the future.

GENOA: SABOTAGED ANTENNA RELAY MARCH 2023

“The logic that commands us is less and less simple profit but even more ruthless scientific logic; Once a scientific discovery is made, it is impossible to go back, even if the resulting technological innovation leads us by the hand to self-destruction.”
ALFREDO COSPITO

In a society that pushes us more and more towards technological alienation, towards a future that excludes real contact by giving our existence a virtual alternative, a place based on the illusion of having control over any aspect of our time, a blinder that distracts us from reality.

As anarchists and anarchists we are aware that there is only one class that has control of hyper-technological society, and it alone enjoys its benefits, so we believe that there is no more concrete sabotage than going to strike at the heart of the future and progress.

Perugia, Italy: Update on the review hearing for re-examination of the precautionary measures in ”operation Sibilla” and statements of some of the comrades under investigation

Update on the review hearing for re-examination of the precautionary measures in operation Sibilla and statements of some of the comrades under investigation (Perugia, 14th March 2023)

The hearing for re-examination of the precautionary measures for anarchists in operation Sibilla of 11th November 2021 took place on March 14th in the bunker courtroom inside the prison of Capanne in Perugia. It concerned the comrades for whom measures were ordered on charges of incitement to commit a crime (414 criminal code), aggravated by the aim of terrorism, in connection with the drafting, publication and distribution of the first six issues of the anarchist newspaper “Vetriolo” and other articles and interventions.

Among the comrades under investigation are Alfredo Cospito, on hunger strike for over 140 days, and Gianluca, currently under house arrest for a year now for the investigation Diamante.
This second re-examination resulted from the Court of Cassation’s ruling last June granting the prosecutor Manuela Comodi’s request, annulling the previous order of the review court which had revoked the precautionary measures in December 2021.

Alfredo Cospito participated in the hearing by video link from the Milan prison of Opera and three comrades under investigation were present in the courtroom in the Peurugia prison of Capanne. The hearing took place behind closed doors, while there were around 40 comrades in solidarity outside. The three comrades under investigation who attended the hearing in the bunker courtroom spoke (two of them with written statements) and each greeted Alfredo warmly. Alfredo made a long statement, in which he was very lucid and was loaded with his usual sarcasm (‘I prefer comedy to melodrama’).’I want to start with the words of my instigator,’ he began, quoting a stance of the current minister of justice Nordio going back to 2019 concerning 41 bis. The comrade then reiterated the meaning and perspective of the hunger strike against the detention regime, which he called a ‘medieval muzzle’ and a ‘metastasis that will spread to political dissent’. Alfredo said he does not accept this non-life and will go on until the end. “For anarchists, who have no organisation, the given word is everything.” That is why he will keep his word, going on to the bitter end. “I will leave with dignity. I hope that those who love me understand that.” The comrade wished to point out that, in the situation in which he is imprisoned, “the only remnants of light I see are the acts of my anarchist brothers and sisters around the world”, “Thank you anarchists. I love you”. Finally, he concluded: “Abolition of the 41 bis regime. Abolition of life imprisonment without parole. Solidarity with all anarchist, communist and revolutionary prisoners in the world”.

Unfortunately, due to the peculiarities of 41 bis, designed specifically to gag prisoners, Alfredo’s full statement is not currently available. We will release it as soon as possible.

After a ridiculous intervention by prosecutor Manuela Comodi who swore that the ‘Perugia public prosecutor’s office is totally uninvolved in the 41 bis measure’, in open contradiction with the words of her boss Cantone (also present in court today), the hearing was closed and the court reserved its decision on the precautionary measures against the investigated comrades.

The decision to move the venue of the hearing to the bunker courtroom of Capanne prison was an obvious attempt to remove the initiative in solidarity with Alfredo away from the city centre. This aim was not achieved because after the hearing the solidarity presence reconvened at the canteen of the University of Perugia, where a banner was unfurled, leaflets were distributed and megaphone interventions were held for over an hour.

Awaiting the release of Alfredo Cospito’s text, we attach below the statements of two comrades under investigation.

Italy: Letter from Alfredo Cospito and update on the latest transfer to San Paolo Hospital on March 6

Posted on 2023/03/16 by darknights

Letter from Alfredo Cospito and update on the latest transfer to San Paolo Hospital on March 6

On Monday, March 6 (the 138th day of his hunger strike) Alfredo Cospito was again transferred from Opera Prison to San Paolo Hospital. Recall that the comrade had been an inmate in the Intensive Assistance Service (SAI) inside the Opera prison since Jan. 30, on Feb. 11 transferred for the first time to San Paolo Hospital, and then transferred again to Opera on the 27th of the same month (following the hearing on the 24th in the court of cassation), remaining there for a week, until this last transfer to San Paolo on March 6.

Following the outcome of the Feb. 24 hearing at the court of cassation (which rejected the petition to revoke his detention in 41 bis, further ratifying what had already been decided by the Rome supervisory court in its Dec. 1 hearing), Alfredo stopped taking the mild supplements he had been taking for some time.

Also in the same days as the latest transfer, on March 6, the opinion requested by the Ministry of Justice from the National Bioethics Committee on the possible medical intervention in Alfredo, that is, on force-feeding in case of loss of consciousness, was released. The CNB stresses that it has “no legal, political, moral or ethical legitimacy to formulate an ‘ad personam’ opinion” (and “consequently, the CNB’s response is of a general nature”), without even issuing an unambiguous opinion, thus dividing itself between the “pro-life” and the “pro-choice” (according to the latter, the Anticipated Treatment Arrangement should be respected in any case).

On March 1, during a press conference, Alfredo’s lawyer disclosed a hitherto undisclosed letter-statement by the comrade, plausibly dating back at least a month. We publish its full transcript here. Recall that to date, due to the systematic censorship inherent in 41 bis, it has not yet been possible to read the comrade’s first statement regarding the beginning of the hunger strike, dating back to October 20. The only statement published to date, other than this letter disclosed on March 1, was the one for the December 5 hearing in Turin as part of the Scripta Manent trial.

The state’s choice to annihilate the comrade poses the need to place, once again, no hope in the outcomes of the courts or in the opinions of the various structures deputed to express their views on the contradictions that have opened up in state bodies as a result of the hunger strike and with the development of the international solidarity movement. These are, especially with regard to the courts of the Italian state, structures and figures directly responsible for the very serious conditions in which Alfredo Cospito finds himself. The state, first with the transfer of the comrade in 41 bis on May 5 and later with the cassation ruling of the Scripta Manent trial on July 6, intended to give a warning to the anarchist and revolutionary movement. A warning that after the outcomes of the hearings of the Rome parole court on Dec. 1 and the court of cassation on Feb. 24 was expressed even more clearly, taking the form of a will to total annihilation against the comrade.

To the attempted annihilation against Alfredo and the constant mass-media campaign of slander the whole anarchist movement we respond with the clarity of our ideas and the tenacity of our practices.

Letter from Alfredo Cospito

My struggle against 41 bis is an individual struggle as an anarchist; I do not do or receive blackmail. I simply cannot live in an inhumane regime like 41 bis, where I cannot freely read what I want, books, newspapers, anarchist periodicals, art, scientific and literature and history magazines.

The only chance I have to get out is to deny my anarchy and sell me someone to put in my place. A regime where I cannot have any human contact, where I can no longer see or stroke a blade of grass or hug a loved one. A regime where photos of your parents are confiscated. Buried alive in a grave, in a place of death. I will carry on my struggle to the bitter end, not because of “blackmail,” but because this is not life. If the goal of the Italian state is to make me “disassociate” myself from the actions of the anarchists outside, know that I do not suffer blackmail. As a good anarchist I believe that everyone is responsible for his own actions, and as a member of the anti-organizational current I have never “associated” with anyone and therefore cannot “disassociate” myself from anyone. Affinity is something else. Continue reading “Italy: Letter from Alfredo Cospito and update on the latest transfer to San Paolo Hospital on March 6” →
