Update on the cassation hearing for the Scripta Manent trial and transfer of anarchist Alfredo Cospito from Terni prison to that of Sassari (Italy, May 25, 2022)

The cassation hearing of the Scripta Manent trial was held today, May 25, in Rome. The attorney general argued for the rejection of all the requests (of the prosecution and the defence) with the exception of the crime of massacre, for which he requested a referral to the court of appeal for the requalification from ‘common massacre’ to ‘political massacre’. The hearing was adjourned to June 27 for the last defence arguments and the final verdict.

Meanwhile, also today, Alfredo Cospito was transferred to Bancali prison, located near Sassari (in Sardinia). As is known, the 41 bis prison regime (the most restrictive penitentiary regime in Italian prisons) was ordered for the comrade, with a measure effective from May 5.

Anarchist comrade Alfredo Cospito has been in prison since September 2012, following the repressive operation that led to his arrest and that of another comrade, both accused of shooting Roberto Adinolfi, the CEO of Ansaldo Nucleare, who was wounded on May 7 of that year in Genoa. The action, claimed by Nucleo Olga of Federazione Anarchica Informale – Fronte Rivoluzionario Internazionale [“Informal Anarchist Federation – International Revolutionary Front”], was then claimed individually by the two comrades also during the first degree trial held in Genoa. In addition to the 9 years and 5 months sentence he received in the trial for the action against Adinolfi, he was sentenced to 20 years in first and second instance in the Scripta Manent trial held in Turin starting in 2017 and derived from the arrests of September 6 of the previous year. Following the Scripta Manent sentences, in addition to Alfredo, Anna is currently imprisoned (in Messina prison), sentenced to 16 years and 6 months.

At the end of June, Alfredo was transferred from the High Security 2 section of the Ferrara prison, where he had been held since 2013, to that of Terni prison. However, he is still kept in the “transit” section, despite the fact that the isolation period imposed by the Covid-19 emergency regulations has been over for several days. We do not know why Alfredo is still in solitary confinement, we do not know or care about the plans of the DAP [“Department of Penitentiary Administration”]. What we do know is that the provocations and pretexts of the guards can not erase a historical fact: the existence over the years of an anarchism of action, an anarchism that has acted with determination, hitting structures and people of the state and capital.

The story of Alfredo, the practices of which he is accused, this is the contagion they fear. But that story can not be erased by the convictions of a court or the pretexts of the jailers; those practices can not be isolated, there is no bubble that holds: they are heritage of the revolutionary anarchist movement.

The comrade has been in prison since September 14, 2012, following the repressive operation that led to his arrest and that of another comrade, both accused of having shot and wounded Roberto Adinolfi, the CEO of Ansaldo Nucleare, on May 7 of that year in Genoa. Around twenty comrades were charged in the trial, with regard to the activities of the FAI (later FAI–FRI) in Italy, involving also specific charges relating to a series of actions realized between 2005 and 2016 and for some anarchist publications and websites run by comrades. In the appeal sentence of November 24, 2020, three comrades were convicted for subversive association with the purposes of terrorism and subversion of the democratic order and for “incitement to commit crimes”. Among these three comrades, Anna Beniamino and Alfredo Cospito were convicted for some actions (explosive attacks and parcel bombs) carried out between 2005 and 2007. In addition, ten other comrades were sentenced for various reasons only for “incitement to crimes”. Currently, in addition to Alfredo, Anna is imprisoned (in Messina prison), sentenced to 16 years and 6 months.

Forgetting the prisoners of the social war means forgetting the war itself: revolutionary solidarity with the imprisoned anarchists.

Concerning Claudio’s detention situation, about two months ago he was transferred from the AS3 unit to the “commons” unit in the prison of Syracuse. The reasons for his transfer have yet to be clarified, but it seems it is a “ministerial” order, i.e. by DAP [Department of Prison Administration] (actually the body that decides over placements in detention). Moreover it was declared that custodial measures for 280bis were not valid, but he remains in prison for ‘carrying and fabricating weapons and explosives with purposes of terrorism’.

We recall that the first grade trial for ”Operation Bialystok” started on 25th February 2021 with statements from the witness for the prosecution Luigi Imperatore, a ROS colonel. On 12th May Imperatore was still the protagonist, carrying on his historical ramblings regarding the anarchist galaxy and actually giving prominence to the usual written “evidence” for lack of concrete facts.

The next hearings will be on 8th and 30th June, when experts for the defence will be heard (concerning accusations against Claudio), who will present their consultation based on the reports produced by the prosecutor. After the summer break hearings will continue on 7th, 9th September and 6th October. From 30/06 hearings will be held in the bunker courtroom of Rebibbia.

A quick update.
Without wasting a minute, the night after the last “Scintilla” preliminary hearing [June 16], they put me back on a plane to send me back to this shitty place, S. Maria Capua Vetere. I knew that the transfer to the north was only a temporary support, but I sincerely thought that I would hhttps://malacoda.noblogs.org/post/2021/06/19/natascia-nuovamente-trasferita-al-carcere-di-santa-maria-capua-vetere-16-06-2021/ave some more time, just as I naively hoped that they would at least read the various petitions submitted, by me and my lawyer, for reassignment to another prison.

Since the day I was transferred here, three months ago, I have not been able to communicate decently with my lawyer: interviews have been reopened, so no video calls or phone calls at the request of the lawyer, phone calls are only one per month lasting 10 minutes, even for defendants and even for those who are 1,000 kilometres away from the trial site or from home. If he is in the mood, the director of the prison can grant a second extraordinary one during the same month, but obviously, as this is a concession, he is under no obligation to do so, and in any case it is out of the question to exceed two monthly. So 20 minutes per month, in a small stuffy room, and at the appointed time and day, hoping that your lawyer will be in the office that day. Twenty minutes a month, from a month and a half before the beginning of the trial [for the “Scintilla” operation, in Turin], until today, when the trial has substantially come to an end. There are two hearings left, before the closing speech of the prosecutor, two hearings in which there should have been reasoning about spontaneous statements, examination and cross-examination, but it seems that I will have to reason alone. On the face of it, it seems as if everything is being done to prevent a “dignified” defence… or rather, any defence at all… just in case the prosecution’s hyperbolic and morbidly house of cards starts to creak. Then it is much better for them if this possibility, that of defending themselves in court, is reduced to a minimum. I will not dwell here on how videoconferencing fits perfectly with this strategy, much has already been discussed about it (though perhaps not enough). It is known that to think badly you’re very often right. Of the twenty days I spent in Vigevano, fifteen were spent in solitary confinement and one in court, and another two days were spent travelling back and forth… in short, not even this was an opportunity to talk to the lawyer, since solitary confinement is not allowed for visitors. Italy: Anarchist comrade Natascia Savio is on hunger strike since June 16

From a video call this morning [June 19] with a comrade, Natascia made it known that on June 16, 2021, on her return to Vigevano prison after the preliminary hearing held in Turin for the ‘Scintilla’ trial in which she is a defendant, her temperature was taken and she was immediately put in an isolation cell. When she realised that she was there to be transferred back to S. Maria Capua Vetere prison [in the province of Caserta, southern Italy], she officially declared the start of her hunger strike, throwing the food out of the cell when it was delivered.

Requests for her to be assigned to another prison have been to no avail, given that her right to a defence is infringed, making it impossible for her to properly follow the trials in which she is accused in Genoa (‘Prometeo’) and Turin (‘Scintilla’) and to meet with her lawyer, both in the courtroom during the hearings and in the preparatory phase. It should also be added that the only motion she was able to present in person came from the prison of Vigevano, because from the prison of S. Maria Capua Vetere they never sent it, remaining in all probability to gather dust on a desk of the prison administration.

Natascia is determined to carry on to the end and not to touch food until the situation has changed.

Strong, determined and with her head held high, Natascia has never stopped fighting even when she was locked up. It is up to us outside to fight alongside her with the same strength and determination.
