Pola Roupa: November 17, 2023. 50 years from the Polytechnic and my release from prison

“After 7 years of consecutive imprisonment (from the arrest of 5th January, 2017), 8.5 years together with pre-trial detention (arrested on 10/4/2010) and 13 years and 6 months in total, sentence I served for my participation in Revolutionary Struggle, I have been released. The symbolism of the day was strong as this year’s November 17th marks the 50th anniversary of the Polytechnic uprising of 1973. On that day, everyone remembers the dead of the Polytechnic but also all those who have fallen in the struggle for freedom.

For me, this day was dominated by the memory of our comrade killed in the activity of Revolutionary Struggle, Lambros Fountas. But in my thoughts is also the comrade Nikos Maziotis who, despite the fact that he has served 11 years’ “closed” prison and 14 years in a mixed prison – a very long period for a 20-year sentence -, the judicial councils of Lamia are refusing to release him. It is now clear that a unique status of exception has been imposed on Nikos Maziotis, as no prisoner in a similar situation (with charges based on 187A) and with a similar sentence (i.e. not a life sentence) has remained in prison for such a long period of time. This exceptional regime based on political criteria and motives and which in practice nullifies the institution of parole – which according to the law is mandatory and not “gratuitous”, given that it is not left to the personal will of the respective judge – this exemption regime must come to an end. In addition to the flagrant violation of his rights, this special regime of exception is reminiscent of a junta-style treatment of a political prisoner.

After spending many years in prison, it would be a lie to say that I am not thinking about the many dozens of female prisoners I have lived together with. On the occasion of the – by mistake I believe – publication that they “discovered” that I was released from prison because I am the mother of an underage child, I have to say that in addition to the fact that I have already served the years of detention required for parole, there is no provision by any penal code for discharge of a prisoner on parole because she is the mother of a minor child. Only article 105 of the Criminal Code of 2019 provides for house arrest for mothers with children under the age of 8, a measure that is not particularly applied.

Having lived with women for many years, I know that most of them have a central role in caring for people such as young children, the elderly, the sick, the disabled, and their prolonged detention has a terrible impact on the lives of those who have remained alone, without their help. Conditional release for mothers of minors and for women who take care of categories of people such as those I mentioned above, is a provision whose absence from the criminal code demonstrates that the legislators do not take into account the pivotal position of women-carers in social life. It is a lack that often costs human lives.”

(EN) End of trial and final declarations of Francisco Solar and Mónica Caballero (Santiago, Chile, 6-7 November 2023)

The final hearings of the first instance trial against anarchist comrades Mónica Caballero and Francisco Solar, arrested on July 24th 2020 and accused (only Francisco) of sending parcel-bombs to the 54th police station and to Rodrigo Hinzpeter, ex minister of the interior and national defence as well as a director of the Quiñenco (25th July 2019), and both of the double explosive attack in the real estate building Tánica (27th February 2020), in the bourgeois district of  Vitacura (in the metropolitan area of Santiago) which took place in the context of the generalised revolt that broke out in Chile in October 2019. The actions against the 54th police station and Hinzpeter were claimed by Cómplices Sediciosos – Fracción por la Venganza, while that of the Tánica by the Afinidades Armadas en Revuelta.

In December 2021 Francisco claimed responsibility for both of the actions, giving the reasons, choice of objectives and revolutionary significance.

On 10th August 2022, after a series of extensions to the investigation period, the preliminary hearings have been concluded and requests for conviction been announced: 30 years’ prison for Mónica and 129 years for Francisco (according to the current judicial system in the Chilean State the public prosecutor’s office makes the requests before the start of the actual trial phase, the juicio oral). On 18th July of this year, after a postponement the trial finally began, which the comrades only attended in person during the first procedure of according to the current judicial system and the last hearing, attending the rest by video-conference.  During the July 18th hearing, the prosecutor, reformulating the initial requests, stated that the prosecutor’s office intends to inflict a sentence of 20 to 25 years on Mónica and one of over 150 on Francisco. During the hearing of 19th July Francisco reaffirmed assumption of responsibility for all the actions. UK: Fireworks at HMP Bristol for Imprisoned Anarchist Toby Shone + Moved to HMP Garth

Posted on 2023/11/19 by darknights

Anarchists gathered at HMP Bristol on Friday 21 September at 8pm. As darkness fell, fireworks were launched over the prison to protest the rearrest of anarchist Toby Shone and to let him know he is never alone.

Toby was arrested by an armed police unit while he was driving to Gloucester at 9am on Tuesday 19 September. The arrest was apparently ordered by Ashley Fussell from the National Security Division Wales and South West. The armed police unit is based at Bamfurlong, Gloucestershire, and was involved in Toby’s original arrest in November 2020.

Toby was arrested and recalled to prison for alleged breach of license conditions. He is accused of having an unauthorised phone and of attending an “anti-state” dinner and letter-writing night for anarchist prisoners held by Bristol Anti-Repression Campaign at BASE Social Centre in August. These alleged breaches apparently warranted an arrest by an armed counter-terrorist unit. The cops want him to serve the remainder of his sentence which means he will not be released until November 11, 2024.

Toby had just been released from the Approved Premises in Gloucester where he had been forced to live since getting out of prison at the end of December last year. Probation could no longer make a case for keeping Toby there under extreme curfew as the hostel needed the room and also didn’t understand why he was still there. He had been in his new flat in the Forest of Dean for just 9 days.

Donations to his support fund can be made to The Bottled Wasp which can be found at brightonabc.org.uk/bottledwasp.html

Fire to the prisons!

Imprisoned Anarchist Toby Shone moved to HMP Garth

Imprisoned anarchist Toby Shone has been moved 265 kilometres from his home in Forest of Dean, Gloucestershire and nearly 300 kilometres from support in Bristol to HMP Garth in Leyland, a high security prison near Manchester. Despite being in the resettlement part of his sentence, a vengeful probation and counter-terror team are attempting to isolate Toby from his perceived support base and loved ones in the south of the country and deliberately place him at risk of harm in a notoriously violent Category B prison for those serving sentences of 10 years or more. Probation has demanded Toby serve the rest of his sentence which is just short of 13 months, due for release on 11 November 2024.

Toby was imprisoned in Wandsworth, Bristol and G4S Prison Parc for nearly two years accused of being the administrator of counter-information project 325.nostate.net. After the political prosecution failed and the cops had to drop the case 5 days before trial in October 2021, Toby received a sentence of 3 years 9 months for possession of psychedelic medicines. He was released on 28 December 2022 under heavy restrictions (license conditions) overseen by a multi-agency team (MAPPA) including the National Security Division (counter-terror) and was forced to live in a filthy bail hostel in Gloucester for 9 months. He had just moved back into a flat in the Forest of Dean in Gloucestershire when, on the morning of 19 September 2023, he was pulled over and arrested by an armed police unit a few miles from the city of Gloucester. He was accused of being in possession of an [unauthorised] phone and attending a dinner and prisoner letter writing night at BASE anarchist social centre in Bristol in August.

Toby continues to be held as a TACT (Terrorist) prisoner despite being proclaimed Not Guilty of any terrorist offence by a High Court Judge in a court of law in October 2021.

Toby is in great spirits as ever and requests letters and emails. Emails are getting through very quickly on emailaprisoner.com (please get him a reply sheet). You can also write to him at:

$hile: Anarchist comrade Francisco Solar’s words in solidarity with Marcelo Villarroel

Posted on 2023/09/21 by darknights

Solidarity is attack

It is not the fruit of a profound analysis that by striking with forcefulness and frequency, it is possible to bend the hand of Power. This has been demonstrated in multiple experiences of struggle in different territories and at different times.

At this moment the situation of comrade Marcelo Villarroel requires, without a doubt, that decision and collective and individual will to make the Power and its legal apparatus bend. There are several documents, writings and communiqués that have been disseminated in recent times that expose Marcelo’s situation and the legal aberration that is being applied to him, where ultimately a clear reason of State is perceived to keep him locked up. Therefore, what remains is to act to get the comrade out on the streets and thus open unsuspected paths for the return to the streets of the anarchist and subversive prisoners.

Marcelo Villarroel to the street!

Anarchist and subversive prisoners to the streets!

Long live anarchy!

$hile: Words by Mónica Caballero in solidarity with Marcel Villarroel

Posted on 2023/09/21 - 2023/09/21 by darknights

For those of us who choose not to accept the discourse of the powerful, we know that the legal principles that underpin the legality of the State are not applied to everyone in the same way. Paper can hold a lot and can show us a vision far removed from reality.

The reality of power denies us that there are people punished for being openly hostile to its dominating forms, and that in pursuit of being the most implacable they violate their own laws. I do not pretend that the Powers That Be act correctly, but I will not lose the opportunity to evidence the use of their dirty tools against those who confront the oppressors.

As of today, Marcelo Villarroel is serving almost 29 years in prison in 3 periods and for years he has not been able to access prison benefits, all because of the sentences he has pending from the military prosecutor’s office. He still has 13 years to serve in prison before he can run for office.

The authorities deny the special treatment that Marcelo has, if he were treated as a common prisoner he would be on the street today.

Down with all the cages!

Germany: Letter from Thomas Meyer-Falk

Posted on 2023/09/18 - 2023/09/18 by darknights

From ABC Brighton: Thomas Meyer-Falk has written about his first few days of freedom after serving 26 years in prison, much of the latter part under an old nazi-era preventative detention law.

How the wind rustles and the acorns fall: A few days of freedom!

On 29.08.2023, after almost 27 years of imprisonment, I was released from the high-security area of Freiburg prison with two hours notice. How does a person feel in such a situation? I would like to report on this after the first 14 days.

On 29.08.2023: The release!

At 8 a.m. I was still sitting in the visiting area of the prison with the probation officer, who might be responsible for me in the future, and we puzzled over when and if a release would take place. At 2 p.m. the time had come – I was discharged and on my way to my new place to live.

I should have been overflowing with happiness, but my focus was on the speedy handling of the move and my first official visits. Already around 3 p.m. I was at the job center and then at the health insurance company. The evening became long, ended after midnight. I got to know people in the new living environment, talked to friends on the phone and immediately started texting. The world of the 21st century had integrated me in a short time: thanks to the local group of the Rote Hilfe e.V. from Freiburg, my smartphone and laptop were ready. It felt surreal to sit on the tram and talk on the phone – just hours before I had sat in a cell with a corded phone and was only allowed to call numbers approved by the prison, and the conversations would be monitored and recorded, as it was always said in an announcement text before calls.

At 8 p.m., for the first time in 27 years, I sat together in a circle of people who voluntarily live together, who had voluntarily taken me in, and where I voluntarily went. It felt just as surreal, but really good. Continue reading “Germany: Letter from Thomas Meyer-Falk” →

Russia: Anarchist Azat Miftakhov was arrested immediately after his release from prison

Posted on 2023/09/15 by darknights

On 4 September 2023, former Moscow State University graduate student and political prisoner Azat Miftakhov was released from penal colony. On the same day Federal Security Service (FSB) has charged Miftakhov in a criminal case for «justifying terrorism». According to FSB, Azat discussed with other prisoners the war in Ukraine and the actions of the anarchist Mikhail Zhlobitsky, who caused an explosion in the FSB building and died in 2018.

Miftakhov refused to plead guilty. On 5 September 2023 the court arrested him for two months, since the new criminal investigation has been opened. You can help the family pay for a lowyer. From abroad: paypal ABC-Moscow is abc-msk@riseup.net (write in the message “for Miftakhov”). From Russia: 5469 3800 5929 3380, Sberbank, Elena Gorban

Background
Azat Miftakhov was arrested on 1 February 2019, after law enforcement officers searched his student’s dorm room, and accused of building an “explosive device” that had been found a year earlier in a city near Moscow, Balashikha. He subsequently claimed that, during interrogation, he was tortured by the police. The prosecution authorities twice ruled that there wasn’t enough evidence to charge Miftakhov so he was released from detention on 7 February 2019.
The same day, he was arrested again and charged with attacking the ruling political party’s office in Moscow. On the night of 31 January 2018, unidentified persons had broken a window at United Russia’s office on Onezhskaya Street, Moscow, and threw inside a smoke grenade. On 18 January 2021, the court found Miftakhov guilty of hooliganism and sentenced him to six years in a penal colony.

Chile: Incendiary outburst at Liceo Confederación Suiza in solidarity with Mónica Caballero and Francisco Solar

Posted on 2023/09/01 by darknights

On Friday, August 25, banners, pamphlets, barricades and confrontations with Molotov were deployed against the presence of Carabineros (COP), in solidarity with Monica Caballero and Francisco Solar who are being accused of the placement and detonation of explosive devices in 2019 and 2020 signed by the cells “Cómplices Sediciosos/Fracción por la Venganza” and “Afinidades Armadas en Revuelta” (Armed Affinities in Revolt).

Banners and leaflets read: “After us will come many more. Liceo a13 active and combative” and “Facing the trial against the comrades: to overflow solidarity with Monica and Francisco”.
