Italy: Operation Scripta Scelera – immediate trial sought for Gaia, Gino, Luigi and Paolo. The trial will begin on Jan. 9

In recent weeks, the four comrades under restrictive house arrest since Aug. 8 for Operation Scripta Scelera were notified of the decree setting the immediate trial and consequently the start of the trial at the Massa court, before the monocratic judge, next Jan. 9, 2024. A total of ten anarchists are involved in the investigation: in addition to the four under house arrest, there are five comrades under the obligation to stay overnight (one among them currently also under the obligation to sign) and one comrade under investigation at large. For all of them, Federico Manotti, prosecutor of the Genoa Public Prosecutor’s Office, had requested arrest in prison for subversive association for the purpose of terrorism, incitement to commit a crime with the aggravating factor of the purpose of terrorism, clandestine printing, as well as only for some also offending the honor and prestige of the president of the republic — offenses allegedly consumed with the editing and distribution of the internationalist anarchist fortnightly “Bezmotivny.” The request for immediate trial concerns only the charges of aggravated incitement to commit a crime and insulting the honor and prestige of the president of the republic.

Recall that the immediate trial is a special procedure characterized by the absence of the preliminary hearing: in fact, it goes from the preliminary investigation to the trial hearing. This procedure is actionable only in the event that the prosecutor and the investigating judge, who must validate the request, believe they have overwhelming evidence of the suspect’s guilt and that he or she is in a state of detention (in prison or under house arrest).

In the recent past, the Rome prosecutor’s office had the tracotence to proceed with this formula in the context of Operation Bialystok, but this did not bring great luck to the inquisitors. Lately, the trial of comrade Marco Marino, known as Zac, has also been taking place under immediate trial.

However, this is the first time, as far as we can remember, that in the context of an anti-anarchist investigation the immediate trial is being triggered for only part of the suspects, breaking the investigation into several strands. This is an obvious attempt to sap solidarity and, above all, to quickly dismiss a part of the proceedings with a precedent that can be used in the future to plug the anarchist press. Czech Republic: The Fenix 2 trial

On 18 and 19 September 2023, at 8:30 a.m., the District Court in Most will hold the next hearing in the Phoenix 2 case. https://antifenix.noblogs.org/post/2019/03/27/what-is-fenix-2-about/

The main charges concerned the support and promotion of the Network of Revolutionary cells (SRB) https://revolutionarycells.noblogs.org/, insurrectional anarchism, as well as blackmail and harm of others property. SRB focused several years on sabotage of the property of police and capitalists. So far, no one was convicted and condemned for these actions.

The defendant Lukáš Borl https://lukasborl.noblogs.org/ admittedly confessed to spray the walls of prison lettering “desire for freedom the repression will not stop” and “death to the state”. He also admitted that he was identifying by amended identity documents. The damage he caused to the prison, he paid. The Court in these two points acknowledged Borl guilty, but dropped from punishment. According to the Head of Senate, Dagmar Šebková the delicts were not serious and also happened long time ago.

The Court in Ústí nad Labem overturned the judgment of the District Court in Most and remanded the case for a new hearing. An expert in the field of in odorology to look into the issue of “scent traces”.

Recall that four anarchists and one environmentalist are charged with offenses punishable by 3 to 10 years in prison. Support the accused directly in court or by another solidarity action.

Naples, Italy: March 28 crackdown operation: first hearing in Zac’s immediate trial set for Sept. 13

Update on Zac

The opening of the trial with immediate procedure for Zac, who was arrested in Pozzuoli (Naples) on March 28 and is currently imprisoned in Terni prison, has been notified by the prosecutor. The immediate proceedings requested by the prosecutor involve skipping the preliminary hearing stage (GUP). Thus, the first hearing will be held directly in an assize court on Sept. 13 in Naples.

We publish a series of updates translated from Spanish on the hearings that took place last week, beginning July 18, in the context of the trial of anarchists Francisco Solar and Mónica Caballero in Santiago, Chile. In particular, we publish those on the July 19-20 hearings and an informational update (in Spanish) on all the hearings from solidarity radio stations. Francisco and Mónica’s presence during the trial in the coming weeks will be via videoconference, while for the final phase, the closing arguments and the reading of the sentence, they will be back in court. During the July 18 hearing, prosecutor Álex Cortez said that for the prosecution he intends to impose a sentence of more than 150 years on Francisco and between 20 and 25 years on Mónica , while during the July 19 hearing Francisco reiterated his assumption of responsibility for all the actions, arguing their reasons and revolutionary significance. The trial against Mónica Caballero and Francisco Solar has begun.

Around 08:30 this Tuesday morning [July 18, ed.], in Santiago’s Centro de Justicia, oral arguments began on the first day of the oral trial by which authorities intend to punish anarchist comrades Mónica Caballero and Francisco Solar for attacking the former minister of the first Piñera government (nefarious repressor Rodrigo Hinzpeter), the 54th police station, located in the northern zone, and the Tánica building in the rich quarter.

The day was held in the Rondizoni building, with the presence of Mónica, transferred from San Miguel prison, and Francisco, transferred from La Gonzalina prison in Rancagua.

At the beginning of the hearing, the defense of the comrades asked for the removal of the excessive and ridiculous security measures, which consisted of handcuffs on the wrists, chains on the feet and a yellow vest, a request that was withdrawn only for the latter, maintaining the remaining measures.

Nicolás Toro, Francisco Solar’s lawyer, during a special broadcast of free anarchist radio stations in support of Mónica and Francisco, said that the trial because of its magnitude could last until September and that as a defense they are trying “to see the different legal aspects that will allow us to have the lowest possible sentences in relation to this attack by the state, this revenge.” The lawyer also referred to the pressure exerted by the media: “Mega has already launched a totally biased service, where they try to criminalize the actions of our comrades. On Tuesday, Nov. 18, 2014, the anarchist occupations Corvaccio Squat and Rosa Nera – Occupied Anarchist Space, located on Via Ravenna in Milan’s Corvetto neighborhood, were being evicted with a huge number of trucks, cops, DIGOS, helicopters, and the like.

On July 3, 2023, the trial process for those resisting the eviction and the ensuing day of struggle that lasted well into the evening came to an end, with sentences of up to eight months.

An abnormal awakening for Corvetto on Tuesday, November 18: in Via Ravenna instead of cappuccino and brioche, breakfast with tear gas and barricades.

It is 7 a.m. when the neighborhood, already alert and on the alert for the much heralded “eviction emergency,” notices the approach of a large number of pickup trucks. They head for Ravenna Street and close with vehicles and men two entire blocks with the clear intention of evicting Corvaccio and Rosa Nera. Genoa, Italy: First-degree sentence of the Diamante trial

First-degree sentence of the Diamante trial (Genoa, Italy, July 5, 2023)

The first-degree sentence of the Diamante trial against anarchist comrades Evelin and Gianluca (arrested on March 16th, 2022) was read out today, July 5th, at the Genoa court. Evelin was acquitted of all accusations and Gianluca was convicted to 4 years and 6 months of prison (plus a fine of 15,000 euro) for ‘illegal possession of explosives’ (art. 1 and 2 of law 895/67) and ‘attempted crime’ (art. 56 c. p., Italian criminal code), while he was acquitted of the accusation of ‘manufacture or possession of explosive materials with the purpose of endangering public safety’ (art. 435 c. p.). The comrades were not tried under the ‘aggravating circumstance of the purpose of terrorism or subversion of the democratic order’ (in relation to art. 270 bis 1 c. p.) because for this aggravating circumstance, present during the investigation phase, there had been no indictment for trial. The prosecutor’s requests had been for 5 years and 6 months (plus a fine of 15,000 euro) for Evelin and 9 years and 6 months (plus 30,000 euro) for Gianluca. We recall that the latter is still under house arrest with all restrictions (prohibition of meetings with persons other than close family members, prohibition of communication and exit permits, etc.). On July 5th, the court of Genoa will hold the hearing for the sentence in the trial against anarchists Gianluca and Evelin, who were arrested on March 16th, 2022, within the Diamante investigation and charged with fabrication and possession of explosive and explosive material. During the hearings on June 7th and 8th, the prosecutor requested a sentence of 9 years and 6 months (plus a fine of 30,000 euros) for Gianluca and 5 years and 6 months (plus 15,000 euros) for Evelin. Italy: Alfredo Cospito and Anna Beniamino were sentenced to 23 years and to 17 years and 9 months

While waiting for a more detailed text about the hearing, we inform that on June 26th, the Turin court of assizes of appeal established the extent of the convictions against anarchists Anna Beniamino and Alfredo Cospito in the Scripta Manent trial, sentencing them to 17 years and 9 months and 23 years respectively. Therefore, the possibility of a life sentence for Alfredo (and 27 years and 1 month for Anna), requested by the Turin public prosecutor’s office during the appeal hearing of December 5th, 2022, and later on June 19th and 26th, was definitively ruled out.

We remind that during the Scripta Manent trial — in addition to accusations of subversive association with the purpose of terrorism and subversion of the democratic order, attack with terrorist purposes, incitement to commit crimes aggravated by the purpose of terrorism, etc. — several accusations and convictions for massacre followed against Anna and Alfredo, first for the action in the bourgeois district of Crocetta (Turin, 2007) and later for the action against Caserma Allievi Carabinieri (Cadets of Carabinieri Barracks, Fossano, 2006). With the requalification by the court of cassation (July 6th, 2022) of the conviction for massacre against public safety (art. 422 of the Italian penal code) into massacre against State security (art. 285 of the penal code), the comrade risked a life sentence due to the prevalence of repeated recidivism over mitigating circumstances. The legislation that established the mandatory life sentence was subsequently amended by the constitutional court with the hearing on April 18th: not a “victory” for the rule of law or a “return” to the principles of the constitution, but a result achieved by the hunger strike against 41 bis prison regime and life imprisonment without possibility of parole and the international solidarity movement that developed between May 2022 and April 2023.

On June 7th and 8th, at the Court of Genoa, there was the prosecutor’s indictment and the defence lawyers’ discussion of the trial against anarchist comrades Evelin and Gianluca. The prosecutor’s requests were for 5 years and 6 months and a fine of 15,000 euro for Evelin and 9 years and 6 months and 30,000 euro for Gianluca [the comrade is currently under house arrest with all restrictions].

A further hearing was postponed to July 5th for the reading of the first-degree sentence.
