During the trial at the Court of Cassation in Rome, an appeal regarding the mitigating factors in the conviction for “political massacre” was reviewed, finally reconfirming the sentences already established in June 2023, after the long hunger strike of Alfredo Cospito against 41 bis, which lasted 182 days. In this way, both comrades remain in prison and under the same isolation measures.

While waiting for a more detailed text about the hearing, we inform that on June 26th, the Turin court of assizes of appeal established the extent of the convictions against anarchists Anna Beniamino and Alfredo Cospito in the Scripta Manent trial, sentencing them to 17 years and 9 months and 23 years respectively. Therefore, the possibility of a life sentence for Alfredo (and 27 years and 1 month for Anna), requested by the Turin public prosecutor’s office during the appeal hearing of December 5th, 2022, and later on June 19th and 26th, was definitively ruled out.

We remind that during the Scripta Manent trial — in addition to accusations of subversive association with the purpose of terrorism and subversion of the democratic order, attack with terrorist purposes, incitement to commit crimes aggravated by the purpose of terrorism, etc. — several accusations and convictions for massacre followed against Anna and Alfredo, first for the action in the bourgeois district of Crocetta (Turin, 2007) and later for the action against Caserma Allievi Carabinieri (Cadets of Carabinieri Barracks, Fossano, 2006). With the requalification by the court of cassation (July 6th, 2022) of the conviction for massacre against public safety (art. 422 of the Italian penal code) into massacre against State security (art. 285 of the penal code), the comrade risked a life sentence due to the prevalence of repeated recidivism over mitigating circumstances. The legislation that established the mandatory life sentence was subsequently amended by the constitutional court with the hearing on April 18th: not a “victory” for the rule of law or a “return” to the principles of the constitution, but a result achieved by the hunger strike against 41 bis prison regime and life imprisonment without possibility of parole and the international solidarity movement that developed between May 2022 and April 2023.

A hearing was held today in the constitutional court on the case of Alfredo Cospito and Anna Beniamino on charges of political massacre (art. 285 c. p.) within the Scripta Manent trial.

The current Cirielli law (year 2005, Berlusconi government) prevents mitigating factors from outweighing aggravating factors in the case of recidivism. In Alfredo Cospito’s case, in particular, this would have resulted in a certain sentence of hostile life imprisonment despite the fact that the action he and Anna are accused of did not cause any victims.

The court therefore found this provision unconstitutional. More, reading the terse press release that came out of the building, the court seems to have raised constitutionality doubts in general with respect to all those cases in which the fixed penalty is configured solely as life imprisonment.

Recall that Alfredo Cospito has been on hunger strike for almost 6 months precisely against 41 bis and hostile life imprisonment. Alfredo Cospito, imprisoned anarchist convicted of the crime “massacre” in the “Scripta Manent” trial – a charge concerning the double explosive attack on the Carabinieri Cadet School in Fossano, claimed by Rivolta Anonima e Tremenda / Federazione Anarchica Informale (RAT/FAI) – has been on hunger strike against the 41 bis prison regime and hostile life imprisonment since Oct. 20, when he was imprisoned in the Bancali prison in Sassari, Sardinia. Since May 5, and after ten years in prison, the state has chosen to reinforce the isolation of the comrade (who until then had contributed significantly to the debate among anarchists with letters, articles and interventions) through the detention regime provided for in Article 41 bis of the Italian Prison Order (the carcere duro), a law-abomination that, in essence, requalifies imprisonment into a form of special isolation even on the intellectual and sensory level. It is a suffocating stranglehold that almost completely nullifies communication and contact with the outside world, a torture of psychosomatic annihilation against militants in order to force them to political “repentance.”

Moreover, the purpose of this regime is to create a barrier to revolutionary-antiauthoritarian dialogue between comrades inside and outside prisons. Systematic censorship and the attempt to annihilate the very existence of political prisoners reveal the teeth of democracy and the fear of authoritarian forces of those who carry and spread the seed of revolt and attack for the demolition of the world of the state and capital.

Alfredo Cospito, a continuer of anarchist discourse and practice, raises the shield of the hunger strike to repel the vindictiveness of the state apparatus. The Italian state, with its fascist practices-through the last elections and beyond-has a long history of confrontational tension with anarchists, its enemies who over the years have had trials and investigations for their actions and beliefs, even at the cost of death.

Also imprisoned in the same annihilation regime are three political prisoners, members of the Red Brigades for the Construction of the Combatant Communist Party (BR-PCC) arrested in 2003, Nadia Lioce, Marco Mezzasalma and Roberto Morandi, while Diana Blefari – also a member of the BR-PCC and a longtime prisoner in the solitary confinement of the 41 bis regime – committed suicide in 2009.

With the approval of the new Penal Code and with the even more recent approval of the new Penitentiary Code by the Greek state, “maximum security” prisons or wards now have as their purpose “increased supervision” of “unruly” prisoners, apart, of course, from political prisoners, convicted under the main counterrevolutionary legal instrument par excellence applied to guerrilla warfare, 187A; all seven years after the abolition of Type C prisons thanks to the struggle waged through hunger strikes by political prisoners at the time. This latest development in the state’s legal arsenal is nothing less than a tendency to absolutize prison conditions, also placing a regulation on social confinement with surveillance and control outside the confines of the prison and opening a serious possibility for the introduction of solitary confinement and torture models (similar to 41 bis) in Greek prisons as well. Prisoners in Korydallos and Domokos prisons are still engaged in resistance mobilizations against the new and further authoritarian Penitentiary Code. Alfredo Cóspito is an anarchist comrade from Turin imprisoned since September 2012 after the kneecapping of Roberto Adinolfi (on May 7), executive director of Italian nuclear company Ansaldo Nucleare. This act claimed by the “Olga” Cell Informal Anarchist Federation / International Revolutionary Front for which he was sentenced to 10 years and 8 months. He was also sentenced to 20 years (first degree), for the explosive attack on the Carabinieri training school in Fossano (Cuneo) on June 2, 2006, claimed by Terrible Anonymous Revolt – Informal Anarchist Federation, which provoked the state response through the operation “Scripta Manent”.

Alfredo has been an anarchist comrade in active praxis for decades. Always consistent with his anti-authoritarian projectuality, he has maintained several antagonistic initiatives for which, even though he has been in prison for more than 10 years, the Italian fascist state does not forgive him.

The events:

At dawn on 6 September 2016, 32 comrades throughout the Italian State were awakened by the civil police (DIGOS). The result of the first part of the police operation called “Scripta Manent”, ordered by the Turin Public Prosecutor’s Office through its investigator Roberto Maria Sparagna, is 15 suspects and 7 arrests. On the other hand, an eighth anarchist, in charge of the Anarchist Black Cross publishing project (now closed), is arrested after a house search against him in which batteries and an electrician’s manual were found. In addition to comrades Alfredo Cospito and Nicola Gai, already in prison since 2012 having been tried and convicted for the injury of Roberto Adinolfi, (CEO of Ansaldo Nucleare) action taken by “Nucleo Olga of FAI/FRI”, comrades Alessandro, Marco, Danilo, Valentina and Anna are arrested. The Turin appeals court failed to pronounce the sentence and turned to the Constitutional Court: the Turin judges are asking whether it is legitimate to be forced to disallow mitigating circumstances for Alfredo Cospito because of his previous penal background. Indeed, this would force them to sentence Alfredo to life in prison, although for an action that caused neither deaths nor injuries.
Next December 19 there will be a new hearing in Turin, a formal hearing aimed at working out the question to submit to the Constitutional Court.
Alfredo and Anna intervened with spontaneous statements. Alfredo reiterated that he will continue his hunger strike until his last breath against 41 bis and life imprisonment without possibility of parole, Anna remarked that anyone with a modicum of critical thinking will know how to identify the principals and perpetrators of his comrade’s annihilation. The people in solidarity in the courtroom greeted the accused comrades with slogans and applause.
Shortly afterwards, a demonstration set off through the streets of Turin that, despite the massive deployment of repressive forces, managed to approach the city center, passing through some of the city’s neighborhoods.

A massacre without a massacre attributed without evidence is the culmination of a growing commitment of Antiterrorism and Prosecution to exorcise the spectre of anarchism of action.
The imposition of the 41 bis regime to Alfredo Cospito, guilty of engaging in relations with the anarchist movement from the prison, is in the same vein. The hunger strike to the end that the comrade has been conducting since October 20th is the last resort against isolation and sensory, physical, psychic deprivation, against a political gag. A gag that even prevented him from reading the reasons for the strike itself.
41 bis is the extreme degree of doggedness of differentiated regimes: prisons where continual solitary confinement and the overcrowding of the common sections are the two faces of a system aimed at annihilating the individual. Prisons where massacres, real ones, have occurred and continue to occur: in the suppression of the 2020 uprisings, in the incessant suicides, in the treatment of the poorest and most fragile of prisoners as ‘residual material’ of the dominant techno-capitalist society.
If anything happens to Alfredo Cospito, any individual doted with critical thought will understand who the instigators and executors of his physical annihilation are, having failed to make the political and ideal one.
