Chile: Trial against Francisco Solar and Mónica Caballero for the actions of the ‘Cómplices Sediciosos – Fracción por la Venganza’ and the ‘Afinidades Armadas en Revuelta’: updates on the July 18-20 hearings and continuation of the trial

We publish a series of updates translated from Spanish on the hearings that took place last week, beginning July 18, in the context of the trial of anarchists Francisco Solar and Mónica Caballero in Santiago, Chile. In particular, we publish those on the July 19-20 hearings and an informational update (in Spanish) on all the hearings from solidarity radio stations. Francisco and Mónica’s presence during the trial in the coming weeks will be via videoconference, while for the final phase, the closing arguments and the reading of the sentence, they will be back in court. During the July 18 hearing, prosecutor Álex Cortez said that for the prosecution he intends to impose a sentence of more than 150 years on Francisco and between 20 and 25 years on Mónica , while during the July 19 hearing Francisco reiterated his assumption of responsibility for all the actions, arguing their reasons and revolutionary significance. To supplement what has been published about the first day of the trial (updates, propaganda agitation activities and the live broadcast of the solidarity radio frequencies), we also include a brief and additional photographic account of the July 18 hearing.

The trial against Mónica Caballero and Francisco Solar has begun.

Around 08:30 this Tuesday morning [July 18, ed.], in Santiago’s Centro de Justicia, oral arguments began on the first day of the oral trial by which authorities intend to punish anarchist comrades Mónica Caballero and Francisco Solar for attacking the former minister of the first Piñera government (nefarious repressor Rodrigo Hinzpeter), the 54th police station, located in the northern zone, and the Tánica building in the rich quarter.

The day was held in the Rondizoni building, with the presence of Mónica, transferred from San Miguel prison, and Francisco, transferred from La Gonzalina prison in Rancagua.

At the beginning of the hearing, the defense of the comrades asked for the removal of the excessive and ridiculous security measures, which consisted of handcuffs on the wrists, chains on the feet and a yellow vest, a request that was withdrawn only for the latter, maintaining the remaining measures.

Nicolás Toro, Francisco Solar’s lawyer, during a special broadcast of free anarchist radio stations in support of Mónica and Francisco, said that the trial because of its magnitude could last until September and that as a defense they are trying “to see the different legal aspects that will allow us to have the lowest possible sentences in relation to this attack by the state, this revenge.” The lawyer also referred to the pressure exerted by the media: “Mega has already launched a totally biased service, where they try to criminalize the actions of our comrades. Athens, Greece: Responsibility claim for the grenade attack upon a vehicle of a prison officer in Haidari by ‘Conspiracy Vengeance’

The group “Conspiracy Vengeance” claimed responsibility for a grenade attack upon a prison officer’s car in Haidari at dawn last Saturday (8/7).

In the current days it is obvious that the right-wing government has as its primary goal a junta mentality for the benefit of the few and against the many marginalized social groups. The regime of police democracy is growing, the repressive mechanisms are getting stronger and stronger. Cops shoot and kill without any consequence, cops invade universities. The slightest dissenting opinion is immediately attacked and silenced by the state of difference and decadence. In these circumstances, this whole repressive mentality has also passed inside the walls. Any form of protest and assertion of the self-evident needs of the prisoners finds “walls raised” and is immediately attacked by the scum and their courtiers who run the prisons. The prison guard in question, Dionysis Tsirgiotis, the chief prison guard at the Korydallos prison, is at the forefront of all events in every way against the prisoners. He is at the forefront of the investigations carried out by the prison guards in the cells of the prisoners. His words, his manner and the line he has drawn in the prison are clearly against all prisoners, preventing them from having a smooth coexistence under confinement. This particular prison guard aims to make life difficult for the prisoners and to climb by any means and through any means to the highest levels of power within the walls. We chose to attack his vehicle with a grenade to make it clear that there will be consequences and immediate responses to any form of behaviour, actions and decisions taken by ridiculous little petty people who think they can impose themselves on the backs of the cops and judges.

No prison guard, no warden, no prosecutor should sleep peacefully serving the interests of the cops and the government against the prisoners. We can just as easily next time make sure that the grenade does not ONLY cause property damage. So think very carefully before making any decision against the prisoners.

Italy: Alfredo Cospito and Anna Beniamino were sentenced to 23 years and to 17 years and 9 months

While waiting for a more detailed text about the hearing, we inform that on June 26th, the Turin court of assizes of appeal established the extent of the convictions against anarchists Anna Beniamino and Alfredo Cospito in the Scripta Manent trial, sentencing them to 17 years and 9 months and 23 years respectively. Therefore, the possibility of a life sentence for Alfredo (and 27 years and 1 month for Anna), requested by the Turin public prosecutor’s office during the appeal hearing of December 5th, 2022, and later on June 19th and 26th, was definitively ruled out.

We remind that during the Scripta Manent trial — in addition to accusations of subversive association with the purpose of terrorism and subversion of the democratic order, attack with terrorist purposes, incitement to commit crimes aggravated by the purpose of terrorism, etc. — several accusations and convictions for massacre followed against Anna and Alfredo, first for the action in the bourgeois district of Crocetta (Turin, 2007) and later for the action against Caserma Allievi Carabinieri (Cadets of Carabinieri Barracks, Fossano, 2006). With the requalification by the court of cassation (July 6th, 2022) of the conviction for massacre against public safety (art. 422 of the Italian penal code) into massacre against State security (art. 285 of the penal code), the comrade risked a life sentence due to the prevalence of repeated recidivism over mitigating circumstances. The legislation that established the mandatory life sentence was subsequently amended by the constitutional court with the hearing on April 18th: not a “victory” for the rule of law or a “return” to the principles of the constitution, but a result achieved by the hunger strike against 41 bis prison regime and life imprisonment without possibility of parole and the international solidarity movement that developed between May 2022 and April 2023.

We are circulating Alfredo Cospito’s statement at the June 19 hearing in the court of appeals in Turin on the calculation of sentences against Alfredo himself and Anna Beniamino as part of the Scripta Manent trial. The comrade was connected via video-conference from the Bancali prison in Sassari (as known, the regulations do not require in-person presence). Replications and sentencing against the comrades are postponed to a later hearing scheduled for Monday, June 26, at 12 noon, also at the Turin court.

This statement of mine is closely related to the trial because it goes into the merits of the sanctioning treatment you imposed on me. Sanctioning treatment that is unconstitutional and contradicts your own laws. Sanctioning treatment, 41 bis, that distorts the very meaning of my imprisonment, imposing on me a senseless censure that limits my right to defense.

It is obvious to all how my trial affair has been used as a sort of cudgel by one political party, “the government,” against another political party, the so-called “opposition.” My last-minute transfer from one section to another in anticipation of the arrival of PD parliamentarians is a striking example. Which shows how the DAP and 41 bis have been exploited for political purposes.

These facts are closely related to this trial because they are the product of past political dynamics that led to our disproportionate prosecution and conviction for political slaughter. To shut my mouth now, at the only time I can defend myself would mean endorsing this dangerous and totalitarian drift. Before talking about Fossano and the so-called “massacre” (although there is little to say, it would be enough to look at the images of the damage of the tremendous explosion) for just two minutes I will have to mention three deaths, two of which I am somehow responsible for, the third death that of Cosimo occurred at the clinical center of Opera, ward 41 bis. Claim of the explosive attack on Fundación Paz Ciudadana

Those who have been here, in the minority and diffuse practice, know that failing an attack is part of the many probabilities that arise in the bravery of the street, when we believe that everything is going well, we are surprised that something escapes from what was arranged and planned.

Deciding on an electrical system to detonate an explosive charge is not a whimsical decision, it is the result of studying the objectives, our forces and our resources for action. With a quick entry and withdrawal from the environment we prioritize the safety of our comrades, understanding that the materials at our disposal come and go, while the life and freedom of our brothers and sisters is the most valuable component of the arsenal.

These bitter situations are softened when we know from practice that although the State, police and prosecutors are careful to protect their territories, neighborhoods, institutions and infrastructures, the attack is still possible in contexts of control and passivity. The attack does not come to life in fervent virtual slogans, it is a threat when it bursts into the streets.

In the face of a mistake we could remain comfortably silent but we are proud to persist in action, charged with memory and militant solidarity. We take the words of the comrades in Bolivia, “Long live all the efforts of the anarchic struggle!” because to advance vertiginously along the paths of confrontation is a victory for our revolutionary horizons. We continue, we know that nothing is over and everything continues, and that our only defeat will be not to try.

On the objective

On April 2, 1992, a gang dressed in suits and ties burst into a large house located on the corner of Valenzuela Castillo and Marchant Pereira streets in the Providencia district in broad daylight to found what we know today as the Fundación Paz Ciudadana (Citizen Peace Foundation). No newspaper or television channel dared to treat them as high-risk criminals, despite the fact that among the attendees that afternoon were Agustín Edwards (great financier of the socio-political destabilization in the 70’s) and other prominent figures of Chilean political corruption such as Carlos Alberto Délano, as well as Nicolás Ibáñez and Nicolás Ibáñez, as well as Nicolás Ibáñez, a well-known ultra-right-wing businessman, who when he ran D&S boasted a life-size bust of Pinochet in the middle of his living room, and other members of Chile’s most powerful business groups such as Bernardo Matte and Guillermo Luksic.

Chile: New date for the Oral Trial against comrades Monica and Francisco

Accused of sending explosive packages against former Interior Minister Rodrigo Hinzpeter and 58th Commissioner, as well as for the explosive attack on the Tanica building, comrades Mónica Caballero and Francisco Solar are about to face trial for these actions.

Although the trial was initially scheduled for May 19, 2023, at the request of the defence, it was rescheduled for July 18, 2023.

Neither guilty nor innocent! Solidarity with the anarchists Mónica and Francisco!

On July 24, 2020, three houses in Santiago de Chile were stormed and the two anarchists Mónica Caballero and Francisco Solar were arrested. They have been in custody since then. They are accused of actions against representatives of state repression, including Rodrigo Hinzpeter, Chile’s former interior minister, and a station of the Carabineros de Chile. The two revolutionaries are also accused of other explosive charges. On May 19, the trial of our two comrades-in-arms will begin. We want to inform ourselves about their situation, their history and ideas as well as the trial and give space to our solidarity. There will be a contribution (via video) by fellow activists from Chile, and we will also read texts by the two prisoners. We also want to eat together.

The Direct Action Cells take responsibility for the attack with a low-powered incendiary/explosive device at the home of the head of the Inspection and Control Corps of the Detention Facilities and Deputy Prosecutor of Appeals Spyridoulas Presveias at 13 Solomou Street in the area of Glyfada, in the early hours of 1/4.

We are sending a clear message to prison prosecutors, prison wardens, prison officers, wardens, directors, social workers who choose to treat prisoners as second-class citizens. Who choose to play dirty political games on their backs. Who become agents of the Ministry of Civil Protection in order to advance themselves and their careers. Gather round because you will find us in front of you. The prosecutor we targeted is at the top of the institution responsible for the internal control of prisons and is directly responsible for all the injustices suffered by prisoners, especially after the passage of the new penal and new prison code.

Spyridoulas Presvias as the head of the Prison Inspection and Control Corps (ΣΕΕΚΚ) is the person whose responsibilities concern the most authoritarian parts of the anti-crime policy. He was appointed by the (former) secretary general of anti-crime policy Sophia Nikolaou, a failed New Democracy politician and declared enemy of prisoners, who a few years ago did everything in her power to murder the communist revolutionary Dimitris Koufontinas. In recent years, and after her appointment as its head, the ΣΕΕΚΚ, in addition to conducting investigations and files within the prison, has been upgraded to a body that can take legislative and administrative initiatives to further repress prisoners within the prison. This agency and the upgrading of its repressive tools is part of the broader planning of the New Democracy government for prisons as reflected in the new penal code and the new penitentiary code and a number of other repressive moves they call anti-crime policy. The state may talk about a “war on crime”, but in reality the policies that follow these declarations do not reduce crime, nor do they work to promote the cohesion of society. On the contrary, these policies are the intensification of the war through the systematic class, social and political exclusion declared by the ruling classes against the social base. And the prisons constitute the ultimate point, the absolute domination of this exclusion over the bodies of those who end up in the concrete tombs of bourgeois democracy. Bandung, West Java, Indonesia: Propane bomb & molotov attack on local parliament building by ‘Free Association of Autonomous Fires’

Yesterday we strike a blow against local parliament building in Bandung, West Java. Armed with propane bomb and molotovs, we managed to destroy huge part of the building resulting in wildfires that destroy most of their archives. During endless demonstration against the newly labour law, where most of the protesters are consisting of movement brokers, wanna-be politician, social anarchists, we choose to strike at a different place. As we will never beg or demand the so called rights from the powers that be. This action is dedicated to Alfredo Cospito, Toby Shone, Monica and Fransisco, Chilean and Greek anarchists imprisoned, and to all anarchist insurgents everywhere!
