Cassation Scripta Manent: some considerations and clarifications

This writing stems from the need to explain to comrades what will happen after the Cassation ruling for the Scripta Manent trial issued on July 6.

Starting with the most serious convictions, the court requalified the explosive attack against the Carabinieri’s student school in Fossano(Cuneo) on June 2, 2006 and claimed by Rivolta Anonima e Tremenda / Federazione Anarchica Informale as a “political massacre” (art. 285 c. p.), referring the case back to the Turin Court of Appeals for a peggiorative recalculation of the sentence with the risk of life imprisonment for comrades Alfredo Cospito and Anna Beniamino.

In addition, all other convictions handed down in the Court of Appeals were upheld with sentences ranging from 2 years and 6 months to 1 year and 6 months for 11 comrades and acquittals for the rest of the defendants.

The convictions and acquittals as of now are final.

In the early morning of Friday 22 July armoured forces of repression entered squat 111 and then evicted it and sealed it with an armoured door, the measures of which seem to have been taken in advance. They confiscated material and, in collaboration with the ever-willing establishment, tried to create an impression, among other things, with sharp kitchen knives and beer.

What is ultimately a squat has been an internal preoccupation from the beginning of their history. It’s the walls; it’s the relationships; it all gets complicated and changed in the course of the scythe of history. All, however, are elevated to full-light stars that point the way to the struggle for freedom and life. Simple as that. These walls, stable and immovable until recently, have housed relationships that are strong but complex and fluid in nature. The paradox of the Argo demonstrates the contradiction of this essentialist conception of the detached and self-contained/moving nature of abiotic beings by linking them to their historical position and the perception of the living beings who observe them and yet are life-giving energies for them. Placing them in dialectical relation to the surrounding world. Squats, therefore, are value-wise equally their walls equally their history, their fixed and transient world. Perhaps one of the most important roles they perform beyond the production of public discourse, interventions of all kinds and intensities, events, is the sharpening of consciences. Our squat, our big house, certainly, although it has fallen short in many ways, if it was anything, was a ‘matrix’ of well-ordered steel consciences that, through word and deed, gave and give steadily from their post in the struggle for freedom. It hosted human and non-human animals, material and archival blossoms on the tree of the struggle for the liberation of nature, land, animals and people. The eleven was neither silence nor storm. The eleven was simply a part of the larger silence before the storm we vowed would come. A page in the tomes of movement history, a thorn in the flesh, another crack in the silence of alienation. “Never say you lost something, better to say you got it back.” Not to the state dregs, nor to oblivion, but to the inevitable end of beings. This knowledge to us non-owners, the natives of cities who have always lived trying not to be trapped does not frighten us. Neither wreckage nor loss frightens us. Italy, like the rest of the world, is pressing ahead with the implementation of the 5G network, but how many really know what it is? First of all, the name: 5G is not related to the frequency of the waves used, but indicates that it is a fifth-generation network, whose waves have A power and frequency several times higher than those used so far. Like most technologies it also originated in the military sphere, in fact the type of waves that will be used by this network, namely microwaves and millimetre waves, are used both for localisation (radar), and as a real weapon of war (Active Denial System).

With the 5G network we will be irradiated twenty-four hours a day by an infinity of these waves, which, due to their technical characteristic, will require the installation of millions of new antennas, at a maximum distance of one hundred metres from each other, depending on the location. One only has to look around to see the continuous installation of new repeaters, or the continuous installation of new antennas on existing ones. What few people know is that there will be many ‘mini-antennas’, camouflaged both in street furniture (lampposts, manhole covers, bus stops, etc.) and in everyday objects, not to mention the thousands of satellites that have been launched, and will continue to be launched, into space, to connect even the most remote places on earth. What is known to date about the network already in use is that it causes serious and irreversible damage genetically, biologically and to the reproductive system, which makes it clear that its enhancement (by means of the installations we have just discussed) will cause even greater damage to all living things, further aggravating a situation which already today appears dramatic.

With blood in our eyes

Saturday July 9th, the court of Treviso sentenced our friend and comrade Juan to 28 years’ prison (plus three years’ probation, 30,000 euro in compensation to the League and 17,000 euro in court costs) because he was held responsible for the attack in Treviso of the Carroccio in August 2018. Following the recent configuration of the charge of ‘political massacre’ – which stipulates life imprisonment – for an explosive attack on the carabinieri barracks in Fossano attributed to the anarchists Anna and Alfredo, this is the highest penalty, in our memory, ever imposed in Italy for a direct action that resulted in no injuries.

Among the infinite possible examples, it can be observed that the charge of ‘political massacre’ was not even brought against the Capaci massacre, [1992, anti-mafia Judge Giovanni Falcone, his wife and three escort cops, are killed in an explosion on the motorway near Palermo, Sicily and seven other people injured] while the fascist Traini was sentenced to 12 years for shooting at immigrants, wounding six of them, (and against a PD [Democratic Party] premises…). The aggravating circumstances of ‘terrorism’ (and of ‘massacres’ with neither dead nor wounded) apply to revolutionaries in general and anarchists in particular. We could also remember what was said in so much of so-called civil society in 2018 about state racism, on immigrants segregated on ships in ports, on the declarations of Interior Minister Salvini.

We say declarations on purpose, because the actual practice of state racism, criminal agreements with Libya, etc. has never been changed by whatever government in charge. But the social consensus towards institutional racism is no mere trifle: the Captain’s [Salvini, Northern League, anti-migrant ex-deputy pm and home minister] daily tweets produced a security decree that increased the possible penalties for picketing and roadblocking to 12 years. As has been the case in Italy since 1975 – in that unique security text that began with the Reale Law and has never been completed – ‘exceptional’ regulations proliferate without any democratic outcry ever leading to the slightest repeal. While we are discovering the obvious these days: that political pressure from a multinational like Uber is behind the taxi competition rules, we pretend that the subject of ‘security’ is instead ‘technical’. As if the tightening of penalties against workers’ picketing was not commissioned by the logistics bosses. If until now no one had taken 28 years in prison for an action such as the one in Treviso, it was not because of legal limitations (with the aggravating circumstance of ‘terrorism’ applied to the individual segments that make up an action – packaging, transport, use of ‘deadly’ materials – one can get close to life imprisonment), but because of social limitations. Spoleto, Italy: The premeptive class warfare of the Italian state

THE PREEMPTIVE CLASS WARFARE OF THE ITALIAN STATE

The arrests that took place in the early morning of Tuesday, July 19, on a warrant from the Piacenza prosecutor’s office are indicative of the repressive climate in Italy and the authoritarian turn underway. Four SI Cobas trade unionists were placed under house arrest for the long cycle of struggles that inflamed logistics from 2014 to 2021. Along with them, two USB unionists were also placed under house arrest and two others are the recipients of other precautionary measures. Prosecutor Grazia Pradella’s charges are of criminal conspiracy, private violence, resisting a public official, sabotage, and interruption of a public service, finalized by extortionist intent in order to obtain better wage conditions for workers.

We do not believe that we should be outraged, as is happening in these hours, by this repressive operation, but rather point out that it is an open manifestation, a true confession, of the mentality of the bourgeoisie in this historical period: for the gentlemen of GLS, Amazon, FedEx-TNT, as well as from the arrogant statements that are being uttered every day by the leaders of Confindustria, everything must be granted, everything must be permissible for them. Even putting up a tough fight for a wage increase becomes extortion. The whole loot belongs to them by right, one must not dare to ask, one must not struggle. The charge of extortion is thus not a scandal, if anything, a sign of the times.

This repressive operation stands in open complicity with the murders of Abd El Salam, which occurred, moreover, in Piacenza itself in 2016, and Adil Belakhdim, who was murdered last year in the province of Novara. In both cases, the murders occurred during a strike picket, the same pickets that have been attacked repeatedly in recent years by police charges and assaults by corporate henchmen. Therefore, judicially attacking self-defense practices means acting basically in concert with the picketers and murderers. There are no isolated arsonists

An anarchist companion, Ivan, was arrested in the Paris region on June 11, 2022. He is suspected of several car arsons: cars with diplomatic plates, cars of the rich, of Enedis, and of others. We consider the arson and sabotage of cars, cell towers, electricity pylons and corporate targets as a strategy of the international anarchist struggle.

The omnipresence of our enemies makes them vulnerable. Some targets seem unreachable, yet all their tentacles are Achilles’ heels. If a company’s headquarters is difficult to access, we can torch one of its many cars, its branches and its power supply. We find joy in severing these tentacles, alone or in groups, with or without claims, with the means at hand or with more sophisticated techniques. In this way, we attack specific structures of domination.

These attacks take place everywhere, all the time, because they are reproducible and the targets are on every street corner. We attack because we do not accept the horror of this world, because it is a way to show our solidarity, because we want to put a grain of sand in the gears of power. For all these reasons, these attacks bring us joy.

Exarcheia, Athens, Greece: Update from the rally-march against the release of cop Korkoneas who killed Alexis Grigoropoulos on 6th December 2008

On Tuesday 5 July a rally was called against the release of Korkoneas. The meeting was called at 20.00 at the intersection of Messolongiou and Tzavella. The response of the people was quite large, and it was decided to hold a march through the streets of Exarchia. The pulse was strong from start to finish, and slogans were constantly shouted, with the aim of demonstrating that “justice” is clearly class-based: On the one hand, it releases the cop-killer of Alexandros, by decision of the Lamia Court of Appeal, the same court of appeal that on the other hand deprives the anarchist hunger striker from 23/5, Giannis Michailidis, of his freedom. The march moved through the streets of Exarcheia, and ended exactly at the point where it started, namely at the monument of Alexandros.

After the end of the march, people chose to clash with the repressive forces that were positioned in the vicinity of Exarcheia, but also in many places in the neighbourhood. Another extreme form of authoritarianism and indiscriminate repression unfolded in Exarchia by the Greek Police assault battalions. Following the attacks by the riot police and DELTA forces, the repressive forces surrounded Exarcheia, drowned the neighbourhood in chemicals again and stormed the shops in the area, where patrons were having a drink. They began to bully and drag people into the pile. Specifically, in the bar “5 streets”, despite the strong protests and disapproval, all the people were brought to the GADA by MAT and OPKE, while not even the employees of the shop were spared from the “sweeping” operation. A spontaneous solidarity gathering was immediately called outside the GADA, where a large number of people in solidarity were present. The people who were arrested were released a few hours later. Exarchia, Saturday night, around 20:30, 26 June 2022. People are starting to gather in Exarchia Square for the march against gentrification, evictions, political denaturalization and state repression in Exarchia. In front of the astonished eyes of the assembled people 5-6 motorbikes of the police group DRASI are defiantly passing by Exarchia Square. Apart from voices denouncing this provocative move by the police and warning of the response they will get the next time they provoke, there is no aggressive move against the police.

What are the police officers going and doing on their part? They leave and come back with more reinforcements to provoke incidents, about 15-20 motorcycles. The result of this is what is recorded in the video.

During their panicked retreat and after once again suffocating the area with asphyxiating gas, they even left behind radios, according to witnesses.

Italy: An update and some considerations on Operation Sibilla and the 41 bis against anarchist Alfredo Cospito

A hearing on the precautionary measures ordered for the repressive Sibilla operation was held at the Court of Cassation in Rome on June 22. The hearing stemmed from an appeal by prosecutor Manuela Comodi against the order of the Perugia review court, which on Dec. 16 had resulted in the annulment of the precautionary measures taken on Nov. 11 in the repressive operation. The Court of Cassation, in spite of the opinion of the Attorney General’s Office (which had called for the rejection of the Perugia prosecutor’s appeal), granted PM Comodi’s request, annulling the order of the review court and ordering a new hearing. The precautionary measures are not effective, and a new review hearing will be ordered for the coming months at the Perugia court.

We would like to take the opportunity of this update to dwell on the reasons that led to the crackdown, adding some of our own considerations derived especially from the recent order to transfer Comrade Alfredo Cospito to a 41 bis detention regime.

In September 2021, following years of investigations conducted by the commands of the Special Operational Grouping of the Carabinieri in Milan and Perugia, eight prison arrests for as many anarchist comrades were requested by the Perugia prosecutor’s office. This order was partly rejected and downgraded by the judge for preliminary investigations. At the same time as this request for arrest, a three-month censure order on correspondence was ordered for comrade Alfredo Cospito, which was subsequently renewed several times.

Thus, on Nov. 11, dozens of searches were carried out by the ROS of the Carabinieri, the Sibilla investigation concerning some 15 comrades was notified, and six precautionary measures were imposed in connection with the charge of incitement to commit a crime with the aggravating factor of the purpose of terrorism: an arrest warrant in prison for Alfredo Cospito (at the time already imprisoned in the Terni jail); the arrest of comrade Michele Fabiani, who was placed under house arrest with all restrictions; and finally, the obligation to stay in the municipality of residence jointly with the obligation to sign three days a week for four comrades. On the very day of the operation, two websites (roundrobin.info and malacoda.noblogs.org) were also blacked out, making their online addresses untraceable, and at present they are still unreachable on Italian territory through conventional browsers (due to technical limitations, the repressive forces were able to order the blackout only in Italy, since it was not possible to completely eliminate the websites in question). As mentioned earlier, after a little over a month, the precautionary measures were all cancelled by the review court. At dawn on 16th March 2022 two anarchists were arrested in Rome by the DIGOS police and the ROS carabinieri on orders of the Power of Attorney of Genoa and Public Prosecutor Federico Manotti.

The charge is fabrication and possession of explosive material (article 1 and 2, bill 895/67) with the intent to attack public safety (article 435 of the penal code), all this with purposes of terrorism and subversion of the democratic order (article 270 bis 1) in collusion with other persons yet to be identified.

Alongside this investigation named “Diamante”, there is another open investigation named “Tenaglia” following incendiary sabotages on pylons, repeaters and server booths which occurred in 2021 in Liguria, and even episodes that happened many years ago, listed, even only formally, and mentioned in previous investigations and failed investigations by the same prosecutor in Genoa. This seems to be more like a strategy to exaggerate the repressive operation, given that there is little or nothing that concretely links these episodes to the reason for the arrest for possession of explosive material.

Obviously in the investigation there is the usual revisitation of significance and analyses often incoherent and botched, which intend to schematise the “trends” of the anarchist movement into “formations” and a superficial job of copy-and-paste on things already written in other anti-anarchist investigations, which we absolutely think are pointless to dwell on.

The investigation that led to the arrest started with the finding of explosive material, electrical material and other devices in a forest in Liguria in June 2021. In the papers of the investigation we read that containers were found by an unknown person who later declared he was looking for drugs, and who after the finding went to report it to the carabinieri together with a friend. The pair collaborated with the police and gave directions and descriptions, and were considered suspects, investigated, intercepted and shadowed by the same carabinieri they turned to, and were later exonerated.

After the finding of the containers, the carabinieri set up photo/video traps to “catch” anyone who went near the area. Subsequently a male person was photographed from behind near the spot, a person whom the police declared they recognized and had identified.
