Italy: Alfredo Cospito and Anna Beniamino were sentenced to 23 years and to 17 years and 9 months

While waiting for a more detailed text about the hearing, we inform that on June 26th, the Turin court of assizes of appeal established the extent of the convictions against anarchists Anna Beniamino and Alfredo Cospito in the Scripta Manent trial, sentencing them to 17 years and 9 months and 23 years respectively. Therefore, the possibility of a life sentence for Alfredo (and 27 years and 1 month for Anna), requested by the Turin public prosecutor’s office during the appeal hearing of December 5th, 2022, and later on June 19th and 26th, was definitively ruled out.

We remind that during the Scripta Manent trial — in addition to accusations of subversive association with the purpose of terrorism and subversion of the democratic order, attack with terrorist purposes, incitement to commit crimes aggravated by the purpose of terrorism, etc. — several accusations and convictions for massacre followed against Anna and Alfredo, first for the action in the bourgeois district of Crocetta (Turin, 2007) and later for the action against Caserma Allievi Carabinieri (Cadets of Carabinieri Barracks, Fossano, 2006). With the requalification by the court of cassation (July 6th, 2022) of the conviction for massacre against public safety (art. 422 of the Italian penal code) into massacre against State security (art. 285 of the penal code), the comrade risked a life sentence due to the prevalence of repeated recidivism over mitigating circumstances. The legislation that established the mandatory life sentence was subsequently amended by the constitutional court with the hearing on April 18th: not a “victory” for the rule of law or a “return” to the principles of the constitution, but a result achieved by the hunger strike against 41 bis prison regime and life imprisonment without possibility of parole and the international solidarity movement that developed between May 2022 and April 2023.

Replications and sentencing against the comrades are postponed to a later hearing scheduled for Monday, June 26, at 12 noon, also at the Turin court.

This statement of mine is closely related to the trial because it goes into the merits of the sanctioning treatment you imposed on me. Sanctioning treatment that is unconstitutional and contradicts your own laws. Sanctioning treatment, 41 bis, that distorts the very meaning of my imprisonment, imposing on me a senseless censure that limits my right to defense.

It is obvious to all how my trial affair has been used as a sort of cudgel by one political party, “the government,” against another political party, the so-called “opposition.” My last-minute transfer from one section to another in anticipation of the arrival of PD parliamentarians is a striking example. Which shows how the DAP and 41 bis have been exploited for political purposes.

These facts are closely related to this trial because they are the product of past political dynamics that led to our disproportionate prosecution and conviction for political slaughter. To shut my mouth now, at the only time I can defend myself would mean endorsing this dangerous and totalitarian drift. Before talking about Fossano and the so-called “massacre” (although there is little to say, it would be enough to look at the images of the damage of the tremendous explosion) for just two minutes I will have to mention three deaths, two of which I am somehow responsible for, the third death that of Cosimo occurred at the clinical center of Opera, ward 41 bis. Update on the June 7-8 hearings of the Diamante trial: prosecutor’s indictment and upcoming hearing for the sentence (Italy)

On June 7th and 8th, at the Court of Genoa, there was the prosecutor’s indictment and the defence lawyers’ discussion of the trial against anarchist comrades Evelin and Gianluca. The prosecutor’s requests were for 5 years and 6 months and a fine of 15,000 euro for Evelin and 9 years and 6 months and 30,000 euro for Gianluca [the comrade is currently under house arrest with all restrictions].

A further hearing was postponed to July 5th for the reading of the first-degree sentence.

A few words for a comrade who dedicated his short and intense life, integrally and to the end, to anarchy. So many years have passed – well over a century of actions, dreams, revolutions – and the revolutionary will of this comrade continues to shine with the infinite wonderful facets of our ideal. Émile is immortal.

Once, the cloister opened for souls weary or disgusted with the spectacles of the world, today we have no other refuge than in hospitals and prisons.

What do anarchists want? The autonomy of the individual, the development of his free initiative, which alone will be able to assure him all possible happiness. If the anarchist admits communism as a social conception, it is by simple deduction, because he understands that it is only in the happiness of all, free and autonomous as he is, that he will find his own happiness.

When a man, in today’s society, becomes a conscious rebel of his own action-and such was Ravachol-it is because he has done in his brain a painful work of analysis whose conclusions are imperative and cannot be evaded except by cowardice. But we recognize no one’s right to say, “Only our propaganda is the good one; outside of it there is no salvation.” It is an old residue of authoritarianism born of true or false reason that libertarians must not tolerate.

Do what you think is best and do it with love.

To those who say, “Hate does not breed love,” answer that it is love, alive, that often breeds hate.

Hate that rests not on low envy, but on a generous feeling, is a healthy and powerfully vital passion.

The more we love our dream of freedom, strength and beauty, the more we must hate that which opposes its future.

In the history of human progress there is only one party; it is the party of movement.

Socialists do not want to understand that the freedom of the individual is necessary to the true freedom of the people.

In the dedication of his book, From the Other Side, Alexandre Herzen specifies a truly revolutionary and effective attitude when he says, “We do not build, we demolish; we do not announce new revelations at all, we suppress the old lie.” This book by Herzen is full of flashes and revelations, but there is no lack of biting remarks in it either: it is a good book for the prison; and away from the street I like to take it as an echo: “The French cannot rid themselves of the idea of monarchical organization; they have a passion for police and authority; every Frenchman is in his soul a police commissioner; he loves alignment and discipline; everything that is independent, individual, irritates him; he understands equality only as leveling and willingly submits to the arbitrariness of the police as long as everyone submits to it. Put a chevron on a Frenchman’s hat and he becomes an oppressor, he begins to oppress anyone who does not wear that rank; he demands respect towards authority.”

The new appeal hearing of the Scripta Manent trial has been scheduled (Turin, Italy, June 19, 2023)

Last Friday, May 12nd, the Constitutional Court concluded the drafting of the motivations with which it opened up the possibility of recognising some type of mitigating circumstances for Alfredo Cospito [on April 19th the comrade interrupted his hunger strike], and thus avoiding a life sentence for him.

As a result of this, immediately, this morning [May 15th], a new appeal hearing was set at the court of Turin during which the judges will recalculate the sentences to be inflicted on Anna Beniamino and Alfredo [the sentences for all the other comrades, following the cassation sentence of July 6th, are already definitive]. The hearing is set for next June 19th. We recall that before the referral to the Constitutional Court, the prosecution had asked to sentence Alfredo to life imprisonment without possibility of parole and Anna to 27 years.

On Tuesday night, we placed incendiary devices at a construction machine of the company Hentschke Bau GmbH in Berlin-Adlershof. Already a few years ago, comrades claimed responsibility for several attacks on the infrastructure of this company, which is also responsible for the construction of the prison in Zwickau. (https://chronik.blackblogs.org/?p=10502) The company was also brought into focus because its owner Jörg Drews is affiliated with the fascist party AfD.

The ruling ideology says that it is necessary to keep people in constant fear so that they do not resist patriarchal and colonial oppression and docilely join the capitalist routine so that they can ultimately be shaped and standardized. All the more encouraging are the signs of those who, even in the moment of almost total isolation, confront fear and do not fall silent in their struggle for a world of solidarity, mutual aid and self-organization. As we take it from the words of the Italian prisoner Alfredo Cospito, who has been on hunger strike for over 6 months since last October to fight against the 41bis regime imposed on him:

“I simply cannot live under an inhumane regime as 41bis means, where I cannot freely read what I want, books, newspapers, anarchist magazines, magazines of art and science as well as literature and history. The only way to escape the regime is to give up my identity as an anarchist and sell it to someone else to take my place. A regime in which I cannot have human contact, in which I cannot pick a handful of herbs or hug a loved one. A regime in which the photos of our parents are stolen. Buried alive in a tomb, in a place of death. I will continue my struggle to the extreme, not because of an “accusation,” but because this is not life.”

Although the hunger strike has ended and we are happy to know Alfredo is alive, this does not mean that we will stop fighting against the prison society. On the contrary, his struggle for dignity, as well as the numerous attacks in which comrades themselves risked their freedom, wrote words of solidarity and in this way connected with each other worldwide, have inspired us. With the strength unleashed by the hunger strike, we continue on the path of attacking all that the world of incarceration and punishment embodies.
