Germany: All my friends are bad kids! – about a (meanwhile discontinued) §129-proceeding against anarchists in Hamburg and Bremen

In the following we want to inform you about a procedure according to §129 in Hamburg and Bremen, describe the collective handling of it and give space to individual voices of affected people.

In summer, some people in Hamburg and Bremen opened their mailboxes and there they were again: letters from the Chief Public Prosecutor Schakau of the General Prosecutor’s Office in Hamburg. From 26.05.2020 to 25.07.2022 investigations of different authorities in a §129-procedure against anarchists in Hamburg and Bremen took place. It was about an association construct to which direct actions, mainly in Hamburg, should be assigned over a longer period of time.
Three of the five people against whom the investigations were mainly directed had already been convicted in 2020 in the so-called Parkbank proceedings and were the three official defendants in these proceedings. In the course of the investigation, two other people were selected as potential members of the constructed association, who were similarly investigated.
It all starts (for us) with a report from the BKA to the Attorney General’s Office suggesting proceedings under §129a (formation of a terrorist organization) against the three defendants. However, this is rejected by Attorney General Geilhorn, as are proceedings under §129 (formation of a criminal organization) at the federal level.
One day later, proceedings under §129 begin in Hamburg, led by Chief Public Prosecutor Schakau. In the course of these investigations, measures are initiated against all five suspects of membership; these run from the beginning of May to the beginning of August 2021 and include observations with photo and video recordings, telecommunications surveillance (tapping telephone conversations and reading text messages), the use of IMSI catchers and silent text messages, as well as Internet surveillance (especially the reading of all known and accessible e-mail inboxes).

In the course of this, a large part of the environments of the five defendants were investigated and a large number of people were affected by almost all of the measures. In this context, it should be mentioned that there were at least two people who were not constructed as (potential) members, whose phones were tapped separately with harebrained explanations. It should also be mentioned that the observations and wiretapping measures took place across federal states (Hamburg, Bremen, Berlin, Bavaria and Saxony) and in several cases by administrative assistance also in other European countries (Austria, Belgium and Spain).
Ultimately, the proceedings are discontinued on 25.07.2022, officially for lack of evidence. “Officially”, because of course – as we know – parallel surveillance against some defendants also took place according to other paragraphs, also under the sign of police “danger defense”. In front of the steamrollers of industrial civilization and progress, one of the last sensible worlds populated by terrifying imagery and enchanted fantasies is disappearing before our eyes: that of the forests. Those that were a fiefdom of the lords who lined the hanged there, or a shelter to escape persecution. Those that represented the darkness where one could abandon one’s hungry offspring or the dense shelter from which to set out on the assault of the existent. Those that harbored mysteries populated by dryads and werewolves or that saw the warship builders and other master forgers come through to strip them en masse. Those that saw in Sherwood daring bandits plundering the rich, in Ariège Demoiselles (*) with soot-covered faces burning and plundering castles, in Courlande of revolutionaries continuing to strike fierce blows against tsarist tyranny, but also witnessing in the Alps or Poland the death by frostbite of migrants driven out by European border guards.

Fundamentally, forests are also ambiguous because of their very etymology, since forest stood for first and foremost the outdoor space not used by villagers-the word savage itself comes from silvaticus, meaning sylvan-before designating vast wooded areas reserved for the nobility and monasteries protected from peasant uses. By a singular inversion of meaning, the word forest, the perilous unknown that Roman civilization could not subjugate, ended up qualifying in a few centuries the territory par excellence of religious and feudal rule, before finally becoming a generic and rather vague term. DER ITALIENISCHE STAAT VERURTEILT JUAN ZU 28 JAHREN IM GEFÄNGNIS.

Am 9. Juli wurde unser Gefährte Juan wegen eines Sprengstoffanschlags auf ein „Nord Liga“-Hauptquartier in Treviso (Italien) mit einer „terroristischen Absicht“ zu 28 Jahren Gefängnis und einer anschließenden dreijährigen Bewährung, verurteilt.
Wenige Tage zuvor hatte das Kassationsgericht den Angriff auf eine Carabinieri-Kaserne in Fossano (Italien), für den die anarchistischen Gefährten Anna und Alfredo in der Berufung verurteilt worden waren, erneut als „politischer Massenmord“ (ein Verbrechen, das mit lebenslanger Haft bestraft wird) eingestuft. In der Zwischenzeit wurde Alfredo in das 41bis-Gefängnisregime verlegt, ein Regime der totalen Isolation, eine Form der Folter, das darauf abzielt, den Gefangenen zur Abschwörung, Reue, Distanzierung und zum Verzicht auf seine eigene Identität und seinen revolutionären Weg zu zwingen.
Die unverhältnismäßig hohen Haftstrafen (im wesentlichen lebenslänglich) und die Anwendung vom 41bis stellen einen beispiellosen Angriff auf die anarchistische Bewegung dar.
Sie stellen den Versuch des Staates dar, das Spiel mit einem Milieu zu beenden, das subversiv und revolutionär geblieben ist und das jahrzehntelange Ermittlungen und Verhaftungen nicht zu brechen vermochten.

The Revolution will not be televised

So what should tempt us to think that the Internet in particular would be a place where today’s revolutionary awakenings would take place? And certainly we are not so short-sighted as to seriously consider this to be the case. Nevertheless, we observe with a certain uneasiness that both the real and the virtual spaces of exchange among anarchists of the German-speaking contexts are fading away. Even though individual projects still receive some attention and almost every tendency of informally organized anarchism has created its own web presence – even though there are still one or two printed and regularly published newspaper projects and dozens and dozens of brochures, books, flyers, newspapers, posters and stickers which are connected to the anarchist idea and wander from hand to hand among comrades – we ask ourselves, to what extent these succeed in carrying the anarchist debate into the public more than sporadically, in the (desperate) attempt to inflame at least a few hearts with the spark of the anarchist idea.

Repeatedly in the past it has been proven that if there is no better alternative, platforms like de.indymedia also have to be used for anarchist exchange. The problem is that anarchist contributions are often deleted there or – perhaps even worse – stand beside deeply authoritarian submissions that absolutely contradict the anarchist idea. No wonder: de.indymedia has always been a platform of the left and will consequently remain so. The fact that more and more decentralized (radical left) alternatives to de.indymedia are currently developing is, in our view, just as incapable of remedying the problem as other strangely conceptualized attempts to create synthesist platforms or even websites of unified organizations selling themselves as contributions to an anarchist debate.

So we want to try with this website, beyond any attempt to pursue synthesist thoughts, to open an informal forum of anarchist discussion, which includes the numerous existing web presences of anarchist projects as well as texts that have not been published on other websites before. It is part of an attempt to engage differing positions in a mutually beneficial debate, not to indifferently juxtapose the contradictory, and we are not afraid to end this attempt should it ever become that.

We choose the form of a web presence reluctantly, in the absence of a realistic perspective to launch a similar project in print or in the form of real encounters, at least in a way that would be accessible from the outside. However, we support all such projects and will likewise discontinue ours at any time should a more appetizing alternative appear on the horizon.

In this sense: Feel free to participate as you see fit and let’s raise the German-speaking anarchist debate to a new level.

Hamburg, Germany: You are the crisis. Claim for the incendiary attack on a government vehicle in the St. Pauli neighborhood

The crises of this world are evidently coming to a climax.
It is certainly no illusion that hard times are coming. Even if we consider the situation of the past decades a catastrophe, the new developments seem much more threatening. This may be because the Corona, climate change and the war in Ukraine are forcing us to look beyond Central Europe. The problems are getting closer and we are now more clearly feeling the effects here as well.

However, the effects of Corona, poverty and war in a city like Hamburg do not affect everyone equally.
As all over the world, marginalized and poor people are affected and forced to flee, starve and homelessness differently than rich people. This situation will only get worse in the coming period. If the rich get scared, they will be even more ruthless in defending “their” property and use even more violence to protect their privileges.

In cities like Hamburg, where the percentage of millionaires is the highest in the country, the social imbalances are much more pronounced.
Just over one in a thousand earns more than a million euros a year. At the same time, one in five children live in poverty. In the wealthy suburbs of the Elbe [Hamburg’s bourgeois district], not even one child in a hundred lives in a “Hartz 4 family” [a family receiving welfare for particularly low incomes], in the poorest neighborhoods almost one in two.

Germany: Letter from anarchist prisoner Thomas Meyer-Falk

To give space to the nameless, faceless and voiceless!

Horror, sadness, rage, anger and a feeling of helplessness, of powerlessness. Short-term flaring up of affects and stirring emotions here, long-lasting, persistent feelings there, and all this before what we call mood, it colors our experience background, it is, so to speak, the primordial layer, the ground of feeling.

It is the global warming, what is called “climate crisis”, as if it would be a temporally manageable crisis and not a generation-spreading world change, before whose foil all further conflicts must be read, because a world-spreading cooperation, a togetherness is demanded.

Instead, horrible wars are raging, the one that touches us in Central Europe for very different reasons in the area of Ukraine, but also in Kurdistan, in Syria, in Yemen, in many regions of Africa. Conflicts in South America, in Asia – basically there is no region of the world where military conflicts are not being waged, which in turn lead to even more horror, grief, anger and rage.

Not to forget the economic antagonisms. Just as trivial as existential: Rich against poor! More and more super-rich against more and more super-poor. More and more exploiters against exploited.

The prisons are full also because of this. People are imprisoned if they don’t want to belong to the super poor anymore. Or if people go beyond the very narrow corridor that government systems keep open for protests to articulate their fear, but also their anger about the existing conditions, they are also locked up. When people express dissenting opinions, as is currently the case in Russia, for example, they can end up in camps. People who can no longer endure the brutal present without being stunned, who take various substances to escape into a colorful world of illusion, are also imprisoned. Depending on the country, even the death penalty is imposed. And people who flee from starvation or an otherwise hopeless living situation, they are also locked up in jails, if not killed, or inhumane border regimes are set up, resulting in the death of countless people.

Solidarity Weeks like this one in August 2022 are an encouragement for those held in prisons as well as for those who are threatened with imprisonment. Because it is a work against forgetting. As a rule, interest in people wanes when their criminal trial is over. But Soli Weeks bring the names, the faces and the voices of those concerned back into the focus of attention.

This is a Sisyphean task, because the number of prisoners is increasing rather than decreasing, and all this happens against the background of existential conflicts and disputes, which in turn attract all attention.

All the more beautiful that there are people outside the walls who fill this week of solidarity in August with life and keep it alive.

Kassel, Germany: Incendiary attack of the car park of the German army

On the night of Thursday to Friday of last week, two vehicles were completely burned in the district of Bad Willhelmshöhe in Kassel (Hessen region). The two cars that were completely destroyed by fire were two civilian vehicles belonging to the German army fleet, parked near the Bundeswehr technical school. The cops say the damage was in the mid-five figures. A small drop in the bucket compared to the huge sums currently being spent on rearmament.

Since all NATO member countries are required to spend at least 2% of their GDP on war preparations, spending on military and armaments products is skyrocketing in Europe. Since then, the German army has been subtly presented to us as an “antiquated troop, reduced to a pitiful size by cost-cutting” and “not fit for combat”. The aim is to convince the public that the huge investments in the military-industrial complex are justified and serve the security of Europe. When at the beginning of this year the war in Ukraine escalated again and the Russian ruling class sent its army to finish annexing the territories in the east of Ukraine that have been disputed for years, the calls for the necessary rearmament of Europe finally found complacent ears.

In a fast-track parliamentary procedure, 100 billion euros of “special budget” were made available to the German army, in addition to arms spending that had already risen to 56 billion dollars by 2021. German arms companies, whose war material will now be massively sold to the Ukraine and produced for NATO armies, are rubbing their bloodstained hands and can say with a clear conscience: this time we are on the right side. Buoyed by this mood, Rheinmetall CEO Armin Papperger, who normally avoids publicity as is appropriate in this industry, is no longer missing an opportunity to promote his group, whose share price has doubled since the start of the war in Ukraine. The fact that the German arms industry is only interested in profits and has no morals is evident in the arms trade with the fascist Erdogan regime in Turkey or with Saudi Arabia, whose army helped to crush the Arab Spring protests in Bahrain in 2011. The big German arms groups have also sold their war machines to Russia, although after the annexation of Crimea an arms embargo was decreed by the EU. In order to do this, the arms dealers used, as is also usual in this sector, a legal loophole to circumvent the embargo. Updates on rebel prisoner Andreas Krebs

Italy: Time is running out. Andreas Krebs must be transferred to Germany immediatly

The transfer procedure to Germany is underway after the last instance sentence against him in Italy became final on May 6, 2022. Andreas Krebs can thus serve the remainder of his sentence in Germany. However, the translation of the necessary documents and the calculation of the sentence equivalence and the length of the sentence will take more months.

However, Andreas K.’s cancer does not give him much time, so it is urgent to speed up the bureaucratic procedures for the transfer considerably.

After the final verdict, he was transferred from the infirmary of the Secondigliano prison to the normal prison, with even worse medical care than before. He is now in solitary confinement in a ventilated pit that is barely the size of a room. The transfer was justified because Andreas Krebs allegedly refused medical treatment in a hospital.

Andreas, for his part, complains that he should have been transferred to a psychiatric ward and demanded his immediate return to prison.

Solidarity appeal for Andreas Krebs

In the following we publish an appeal for solidarity and donations for Andreas Krebs. Andreas has been in prison in Naples, Italy for several years, before that he spent a large part of his life in various prisons throughout Germany. In the meantime he is in solitary confinement with permanent surveillance.
During his time in prison, Andreas always showed solidarity with other prisoners, publicized his prison conditions and fought against the prison system. He is in very poor health and mentally, his condition has deteriorated drastically in recent years and months. He is dependent on outside support.

Berlin, Germany: Arson attack on a vehicle of the Greek Embassy

Attentively we have followed how the Greek state crushes demonstrations in the streets of Athens. The government of Nea Dimokratia and its judiciary have proven that in the hunger strikes of D. Koufontinas and G. Michailidis, they are ready to let prisoners die rather than give in one step. We know the videos of the lynching with the participation of police officers of Zak Kostopoulos. As well as the execution of N. Sampanis in Perama by DIAS is an expression of a ruthless regime, as is the murder of Vassilis Maggos in Volos. Blood drips from the hands of the Greek authorities.

The new junta thinks it is smart to take advantage of the August vacation period to begin construction of the metro station in Exarcheia. Their goal is to destroy every social base and occupy every place of resistance with troops. The evictions of squats in Thessaloniki and the police invasion of the university there have not escaped us either.

Everywhere the Greek state encounters resistance from parts of society. We want to support this resistance in order to bring down the project of ND. The system of ND, its judiciary and its cops, is the state of rapists. The release of rapists and the simultaneous attack on a feminist demonstration in July in Athens, symbolizes the values of Mitsotakis’ government.

Berlin, Germany: Burning of Hertz truck – not only for hunger striker Michailidis

We use simple means to sabotage the enemy’s infrastructure. That the car rental company Hertz is an enemy became known not only after an attack on their branch* and further fires of their vehicle fleet in Athens. Not only the Greek police is equipped by Hertz with vehicles at preferential conditions, but also in other states active and former cops and military are supported according to self-advertisement.

Hertz is one of the companies that force the constant need for mobility. Everything and everyone must always be immediately available everywhere. Delivery services, rental vehicles and Uber now dominate traffic in cities. Along the way, they create data collections about moving things and people for the police’s tracing computers, Hertz also by filming drivers while they drive.

In the social war and in the war state against state, we stand flagless on the side of the oppressed against the oppressors and Hertz stands on the side of power, sometimes under the Greek flag in the jeeps of OPKE, sometimes under the US flag on the trucks of the National Guard or under the flag of capital on their vans, with which they profit in Germany from the compulsion of the citizens to constantly move to another place from expensive apartments.

On the night of May 25, we set fire to a Hertz truck in the northern Berlin district of Reinickendorf as a minimal sign of our solidarity for Giannis Michailidis, who has been on hunger strike in Malandrinos prison since May 23.

We also wish Lina, who has been in pre-trial detention for 18 months, much strength and freedom.

At the same time, our action is in the framework of similar acts around the world that burn to ashes everything that can be useful for the war.
